Federal Communications Commission DA 21-839 DA 21-839 Released: July 23, 2021 WIRELESS TELECOMMUNICATIONS BUREAU GRANTS AUCTION 107 LICENSES Auction No. 107 By this Public Notice, the Wireless Telecommunications Bureau (WTB) announces the grant of 19 long-form applications and issuance of 5,676 licenses. On February 17, 2021, the Federal Communications Commission (Commission) completed the auction of licenses in the 3.7-3.98 GHz (3.7 GHz) band, and the Office of Economics and Analytics (OEA) and WTB announced the results of that auction on February 24, 2021. Auction of Flexible-Use Service Licenses in the 3.7-3.98 GHz Band Closes; Winning Bidders Announced for Auction 107, AU Docket No. 20-25, Public Notice, DA 21-207 (OEA & WTB Feb. 24, 2021). This auction raised a total of $81,114,481,921 in net bids ($81,168,677,645 in gross bids), with 21 bidders winning a total of 5,684 licenses. “Gross bids” refers to the total amount of winning bids at the close of bidding and does not reflect any small business or rural service provider bidding credits claimed by eligible winning bidders. “Net bids” refers to the total amount of winning bids as adjusted for any small business or rural service provider bidding credits claimed by winning bidders. Long-form applications for licenses won in Auction 107 were due on March 10, 2021. WTB accepted Auction 107 applications for filing on April 2, 2021. Wireless Telecommunications Bureau Announces that Applications for Auction 107 Licenses Are Accepted for Filing, Public Notice, DA 21-380 (WTB Apr. 2, 2021). Upon further review and examination, WTB finds the applications for the licenses listed in Attachment A to be complete and in conformance with the Commission’s rules. Two petitions to deny were filed by DISH Network Corporation (DISH) requesting that the Commission deny or designate for hearing the long-form applications of Cellco Partnership (Cellco) and T-Mobile License LLC (T-Mobile). In the DISH Order, WTB and OEA denied DISH’s petitions and indicated that the long-form applications of Cellco and T-Mobile would be processed consistent with the Order and the Commission’s rules. T-Mobile License LLC; Cellco Partnership; Applications for 3.7-3.98 GHz Band Licenses, Auction No. 107, Memorandum Opinion and Order, DA 21-891, at 16 (WTB & OEA July 23, 2021). As indicated above, based on a review and examination of those applications, we find them to be complete and in conformance with the Commission’s rules, and, accordingly, we have included them among the applications listed in Attachment A. We find that granting the applications for the licenses listed in Attachment A serves the public interest, convenience, and necessity. Review of applications that previously were accepted for filing, but are not listed in Attachment A, is ongoing. Furthermore, the Commission has received full payment for the licenses listed in Attachment A, as required by section 1.2109(a) of its rules. 47 CFR § 1.2109(a). Accordingly, by this Public Notice, we announce the grant of the licenses listed in Attachment A. We grant these licenses pursuant to section 309(a) of the Communications Act, 47 U.S.C. § 309(a), and sections 0.131 and 0.331 of the Commission’s rules, 47 C.F.R. §§ 0.131, 0.331. We remind licensees that they should review the Commission’s part 27 rules and all Commission orders and public notices establishing rules and policies for the 3.7 GHz band. See 47 CFR pt. 27; see also Expanding Flexible Use of the 3.7 to 4.2 GHz, GN Docket 18-122, Report and Order and Order of Proposed Modification, 35 FCC Rcd 2343 (2020) (3.7 GHz Report and Order); Expanding Flexible Use of the 3.7 to 4.2 GHz, GN Docket 18-122, Order, 35 FCC Rcd 10469 (2020). Each licensee is solely responsible for complying with all FCC rules and regulations associated with these licenses. Notably, 3.7 GHz Service licensees are responsible for timely payment of their pro rata share of the reasonable relocation costs and accelerated relocation payments to satellite and earth station incumbents as set forth in the 3.7 GHz Report and Order.
