INTRODUCTION 1. The Video Division, Media Bureau (Bureau), has before it a petition for rulemaking filed July 7, 2021, by KPTV-KPDX Broadcasting Corporation (Petitioner), the licensee of KPTV (FOX), channel 12, Portland, Oregon. Petition of KPTV-KPDX Broadcasting Corporation for Rulemaking (filed July 7, 2021), LMS File No. 0000151885 (Petition). The Petitioner requests the substitution of channel 21 for channel 12 at Portland in the DTV Table of Allotments. On April 13, 2017, the Commission completed the incentive auction and broadcast television spectrum repacking authorized by the Spectrum Act. See Middle Class Tax Relief and Job Creation Act of 2012, Pub. L. No. 112-96, §§ 6402 (codified at 47 U.S.C. § 309(j)(8)(G)), 6403 (codified at 47 U.S.C. § 1452), 126 Stat. 156 (2012) (Spectrum Act); Incentive Auction Closing and Channel Reassignment Public Notice: The Broadcast Television Incentive Auction Closes; Reverse Auction and Forward Auction Results Announced; Final Television Band Channel Assignments Announced; Post-Auction Deadlines Announced, GN Docket No. 12-268, Public Notice, 32 FCC Rcd 2786 (2017). The post-incentive auction transition period ended on July 13, 2020. The Media Bureau will amend the rules to reflect all new full power channel assignments in a revised Table of Allotments. Because the Table has not yet been amended, the Division will continue to refer to the Post-Transition Table of DTV Allotments, 47 CFR § 73.622(i) (2018), for the purpose of this proceeding. II. BACKGROUND 2. In support of its channel substitution request, the Petitioner states that the Commission has recognized that VHF channels have certain characteristics that pose challenges for their use in providing digital television service, including propagation characteristics that allow undesired signals and noise to be receivable at relatively far distances and nearby electrical devices to cause interference. Petition at 1-2, citing Innovation in the Broadcast Television Bands: Allocations, Channel Sharing and Improvements to VHF, ET Docket No. 10-235, Notice of Proposed Rulemaking, 25 FCC Rcd 16498, 16511, paras. 42, 44 (2010): Amendment of Parts 73 and 74 of the Commission’s Rules to Establish Rules for Digital Low Power Television, Television Translator, and Television Booster Stations and to Amend Rules for Digital Class A Television Stations, 26 FCC Rcd 10732, 10750, para. 37 (2011) (“As a result of the full power digital television transition, some full power stations on VHF channels have experienced reception problems and such problems have not been alleviated even by allowing these stations to operate with the maximum power permitted under the full power television rules.”); Assessment and Collection of Regulatory Fees for Fiscal Year 2020, MB Docket No. 20-105, Report and Order and Notice of Proposed Rulemaking, 35 FCC Rcd 4976, 4997, para. 52 (2020). According to the Petitioner, it has received numerous complaints of poor or no reception from viewers, and explains the importance of a strong over-the-air signal in the Portland area during emergencies, when, it states, cable and satellite services may go out of operation. Petition at 2-3. Finally, the Petitioner demonstrated that the channel 21 noise limited contour would fully encompass the existing channel 12 contour, and an analysis using the Commission’s TVStudy software indicates that Petitioner’s proposal would result in an increase in population served. Id. at 3; Engineering Statement in Support of Petition for Rulemaking at 2 (39,677 persons are predicted to receive KPTV-TV service for the first time and 499 persons would gain a second over the air signal). III. DISCUSSION 3. We believe that the Petitioner’s channel substitution proposal warrants consideration. Channel 21 can be substituted for channel 12 at Portland, Oregon, as proposed, in compliance with the principal community coverage requirements of section 73.625(a) of the Commission’s rules (rules), 47 CFR § 73.625(a). at coordinates 45-31-18.0 N and 122-44-57.0 W. In addition, we find that this channel change meets the technical requirements set forth in sections 73.616 and 73.623 of the rules. 47 CFR §§ 73.616, 73.623. 4. We propose to substitute channel 21 for channel 12 for KPTV with the following specifications: City and State DTV Channel DTV Power (kW) Antenna HAAT (m) Portland, Oregon 21 1000 543 5. Accordingly, we seek comment on the proposed amendment of the Post-Transition Table of DTV Allotments, section 73.622(i) of the rules, 47 CFR § 73.622(i). for the community listed below, to read as follows: Channel No. City and State Present Proposed Portland, Oregon 8, *10, 12, 40, 43, 45 8, *10, 21, 40, 43, 45 IV.
