Federal Communications Commission DA 22-570 DA 22-570 Released: May 23, 2022 DOCKET ESTABLISHED FOR MONITORING COMPLIANCE WITH CONDITIONS IMPOSED IN THE VERIZON-TRACFONE TRANSFER OF CONTROL ORDER GN Docket No. 21-112, WT Docket No. 22-210 By this Public Notice, the Wireless Telecommunications Bureau (Bureau) announces the opening of a new docket to monitor compliance with commitments imposed as conditions by the Commission. On November 22, 2021, the Commission released an order approving the application for the transfer of control of a section 214 authorization from América Móvil S.A.B. de C.V. (América Móvil), and TracFone Wireless, Inc. (TracFone) to Verizon Communications Inc. (Verizon). Application of Verizon Communications Inc. and América Móvil, S.A.B. de C.V. for Consent To Transfer Control of International Section 214 Authorization, GN Docket 21-112, Memorandum Opinion and Order, FCC 21-121, at 54, paras. 151-54 (Nov. 22, 2021) (Verizon-TracFone Order). As part of its approval, the Commission imposed a number of commitments by Verizon as conditions to ensure that the proposed transaction served the public interest, including protections for Lifeline and low-income consumers, conditions involving customer migration and transition, wholesale services, and the unlocking of devices, as well as compliance and reporting obligations. Verizon-TracFone Order at 49-54, paras. 129-49. The Commission also required the appointment of an independent compliance officer and the filing of periodic reports to help ensure that the conditions were fulfilled. Id. at 53, paras. 146-48. By this Public Notice, we are opening a new docket, WT Docket No. 22-210, for the purpose of monitoring compliance with the conditions imposed by the Commission, which is captioned “Monitoring Compliance with Conditions Imposed in the Verizon-TracFone Transfer of Control Order.” Ex Parte Rules. This proceeding shall be treated as a “permit-but-disclose” proceeding in accordance with the Commission’s ex parte rules. See 47 CFR §§ 1.1200 et seq. Persons making ex parte presentations must file a copy of any written presentation or a memorandum summarizing any oral presentation within two business days after the presentation (unless a different deadline applicable to the Sunshine period applies). Persons making oral ex parte presentations are reminded that memoranda summarizing the presentation must: (1) list all persons attending or otherwise participating in the meeting at which the ex parte presentation was made; and (2) summarize all data presented and arguments made during the presentation. If the presentation consisted in whole or in part of the presentation of data or arguments already reflected in the presenters written comments, memoranda, or other filings in the proceeding, the presenter may provide citations to such data or arguments in his or her prior comments, memoranda, or other filings (specifying the relevant page and/or paragraph numbers where such data or arguments can be found) in lieu of summarizing them in the memorandum. Documents shown or given to Commission staff during ex parte meetings are deemed to be written ex parte presentations and must be filed consistent with section 1.1206(b) of the Commission’s rules. In proceedings governed by section 1.49(f) of the rules or for which the Commission has made available a method of electronic filing, written ex parte presentations and memoranda summarizing oral ex parte presentations, and all attachments thereto, must be filed through the electronic comment filing system available for that proceeding, and must be filed in their native format (e.g., .doc, .xml., .ppt, searchable .pdf).
