By this Public Notice, the Public Safety and Homeland Security Bureau (Bureau) seeks comment on the Region 34 (Oklahoma) The Region 34 (Oklahoma) 800 MHz NPSPAC planning area includes the entire state of Oklahoma. - Regional Planning Committee’s (RPC) proposed modifications to its 800 MHz National Public Safety Planning Advisory Committee (NPSPAC) Plan. See Region 34 NPSPAC Plan Update, PR Docket No. 93-58 (dated Dec 1, 2020 but filed in the docket on Apr. 21, 2022) (Plan Amendment). Background. The Commission’s policies require each RPC to prepare and submit a regional plan for public safety use of the NPSPAC band in their respective Region. See 47 CFR § 90.16 (no assignments will be made in spectrum designated for the Public Safety National Plan until a regional plan for the area has been accepted by the Commission); see also Development and Implementation of a Public Safety National Plan and Amendment of Part 90 to Establish Service Rules and Technical Standards for Use of the 821-824/866-869 MHz Bands by the Public Safety Services, Gen. Docket No. 87-112, Report and Order, 3 FCC Rcd 905 (1987) (National Plan Report and Order). The RPCs may update their regional plan as needed to reflect changes in the disposition of NPSPAC channels within the region, technical requirements, or procedures for assigning channels. See National Plan Report and Order, 3 FCC Rcd at 911 para. 57. Region 34 Amendment. On April 21, 2022, the RPC submitted an amendment to the Region 34 - 800 MHz NPSPAC Plan. See Plan Amendment. In its amendment, the RPC proposes to update the channel plan to reflect the relocation of the NPSPAC band per band reconfiguration to the 806-809 MHz/ 851-854 MHz segment of the 800 MHz band. Id. at 28-33. It also seeks to modify the text of the plan to, among other things: · Update the definition of a licensee’s service area and the propagation standard used to calculate the service contour; Id. at 23-24. · Modify the criteria for co-channel interference protection; Id. at 24-25. · Adjust adjacent-channel protection standards to account for widespread use of narrowband technology like Project 25 (P25); Id. at 25. · Require applicants seeking to license channels in the NPSPAC band to submit applications to the RPC through the CAPRAD processing system; Id. at 13. CAPRAD is the Computer Assisted Pre-Coordination Resource and Database System. · Update the committee members. Id. at 36. Region 34’s RPC received concurrence letters for the proposed Plan Amendment from its nine adjacent regions: Region 4 (Arkansas), Region 7 (Colorado), Region 16 (Kansas), Region 24 (Missouri), Region 29 (New Mexico), Region 40 (Texas – Dallas), Region 52 (Texas - Lubbock). The Bureau has reviewed the Region 34 Plan Amendment and finds that it sufficiently complies with the applicable Commission rules and policies, and tentatively accept it. Request for Comments on the Region 34 Plan Amendment. Prior to taking further action on the RPC’s proposal to amend its 800 MHz NPSPAC plan, by this Public Notice, we solicit comment on the Region 34 Plan Amendment. The Plan Amendment is available through ECFS at ecfs@fcc.gov under PR Docket No. 92-171. Instructions for Filing Comments Pursuant to Sections 1.415 and 1.419 of the Commission’s rules, 47 C.F.R. §§ 1.415, 1.419, interested parties may file comments on the Region 34 700 MHz Plan Amendment on or before July 18, 2022.
