FORM 477 FILINGS FOR JUNE 30, 2022 DATA ARE DUE SEPTEMBER 1, 2022

With this Public Notice, the Office of Economics and Analytics (OEA) notifies all parties required to file FCC Form 477 See generally FCC, FCC Form 477 Local Telephone Competition and Broadband Reporting Instructions at 5-9 (Nov. 30, 2021), https://transition.fcc.gov/form477/477inst.pdf. 
 that the filing deadline for the Form 477 data as of June 30, 2022 is September 1, 2022.  The FCC’s Form 477 filing interface, available online at https://apps2.fcc.gov/form477/login.xhtml, is accepting data as of June 30, 2022.
Separate and apart from filing Form 477, most facilities-based broadband service providers must also file data on the availability of, and subscriptions to, mass market internet access service available as of June 30, 2022 in the Broadband Data Collection. Establishing the Digital Opportunity Data Collection; Modernizing the FCC Form 477 Data Program, WC Docket Nos. 19-195, 11-10, Third Report and Order, 36 FCC Rcd 1126, 1130-31, 1133-34, paras. 10-11 & n.42, 16-17 (2021).  The Broadband DATA Act requires the Commission to collect broadband Internet access service data from each “provider of fixed or mobile broadband Internet access service.”  Broadband Deployment Accuracy and Technological Availability Act, Pub. L. No. 116-130, 134 Stat. 228 (2020) (codified at 47 U.S.C. §§ 641-646) § 641(11).

Accurate and timely submission of FCC Form 477 is mandatory for affected entities (see https://www.fcc.gov/form477/WhoMustFileForm477.pdf).  Service providers that are required to file Form 477 but fail to do so may be subject to enforcement action under sections 502 and 503 of the Communications Act and any other applicable law. See 47 U.S.C. §§ 502, 503.
