These notifications are filed pursuant to Sections 63.11 and 1.768 of the Commission's rules, 47 CFR §§ 63.11 and 1.768. FCN-NEW-20220811-00002 E Telstra Incorporated Notification Pursuant to section 63.11 of the Commission's rules, Telstra Incorporated (Telstra USA) - which holds international section 214 authorizations ITC-214-19960610-00238, ITC-214-19960610-00240, ITC-214-19960610-00241, ITC-214-19970610-00320, and ITC-214-19970610-00321 - has notified the Commission of its affiliation with the following carriers: Digicel (Fiji) Pte Ltd. in Fiji; Digicel (Nauru) Corporation in Nauru; Digicel (PNG) Limited in Papua New Guinea; Hitron Limited in Papua New Guinea; Digicel (Samoa) Limited in Samoa; Digicel (Tonga) Limited in Tonga; Digicel (Vanuatu) Limited in Vanuatu; and Digicel Carrier Services (Pacific) Ltd. in Hong Kong. 47 CFR § 63.11. Pursuant to section 63.11(b)(2)(ii), Telstra USA agrees to comply with the dominant carrier safeguards in section 63.10 of the Commission's rules with respect to the U.S.-Nauru, U.S.-Papua New Guinea, U.S.-Samoa, U.S.- Tonga, and U.S.-Vanuatu routes. 47 CFR §§ 63.10, 63.11(b)(2)(ii). Additionally, according to Telstra USA, (1) Digicel (Fiji) Pte Ltd has less than 50% of the mobile market on the foreign end of the U.S.-Fiji route and has no participation in the fixed local access market or in international facilities, and (2) with regard to the U.S.-Hong Kong route, Digicel Carrier Services (Pacific) Ltd lacks a 50% market share in the international transport and local access market. Therefore, according to Telstra USA, it continues to qualify to be regulated as non-dominant under section 63.10 of the Commission's rules for these affiliations. 47 CFR § 63.10.
