Federal Communications Commission DA 24-57 DA 24-426 Released: May 6, 2024 MEDIA BUREAU ANNOUNCES PUBLICATION OF FORM 395-B FOURTH REPORT AND ORDER AND ORDER ON RECONSIDERATION MB Docket No. 98-204 On February 22, 2024, the Commission released the Form 395-B Fourth Report and Order (Fourth Report and Order) and Order on Reconsideration (Order on Reconsideration). Review of the Commission’s Broadcast and Cable Equal Opportunity Rules and Policies, MB Docket No. 98-204, Fourth Report and Order and Order on Reconsideration, FCC 24-18 (rel. Feb. 22, 2024) (Fourth Report and Order and Order on Reconsideration). The Fourth Report and Order reinstates the Form 395-B data collection for broadcast licensees, requiring them to report race, ethnicity, and gender information about employees within specified job categories on an annual basis, as required by the Communications Act of 1934, as amended. The Order on Reconsideration amends section 73.3612 of the Commission’s rules to incorporate language prohibiting use of this collected data for assessing compliance with the nondiscrimination or equal employment opportunity requirements of section 73.2080 of the Commission’s rules. By this Public Notice, the Media Bureau (Bureau) announces that the Fourth Report and Order and Order on Reconsideration were published in the Federal Register on May 3, 2024, and shall be effective as of June 3, 2024.
