This is a Notice of Violation (Notice) issued pursuant to section 1.89 of the Federal Communication Commission’s (FCC or Commission) rules 47 CFR § 1.89. to Hangzhou Hikvision Digital Technology Co., Ltd (Hikvision) and its wholly owned subsidiary Hikvision USA, Inc. (Hikvision USA) (collectively, Company or Hikvision). Bureau engineers reviewed the test reports to determine if they validly supported the authorization under which Hikvision was marketing the models in the United States. 3. The results of that review indicated that 10 test reports did not validly support the authorization under which Hikvision marketed the associated model in violation of section 302a(b) of the Communications Act of 1934, as amended (Act), 47 U.S.C. § 302a(b). and sections 2.803 and 2.906 of the Commission’s rules 47 CFR §§ 2.803(b), 2.906. because the test reports indicated that conducted and/or radiated emissions exceeded those allowed under sections 15.107 and/or 15.109 of the Commission’s rules, 47 CFR §§ 15.107 (conducted limits), 15.109 (radiated emission limits). respectively, or the tests were not conducted under the correct parameters. A summary of the relevant information provided by Hikvision in its response to the LOI is set forth in Exhibit A, with each row of Exhibit A constituting a separate violation of the Act and the Commission’s rules. 4. Pursuant to section 403 of the Act, and section 1.89 of the Commission’s rules, we seek additional information concerning the violations and any remedial actions taken. 47 U.S.C. § 403; 47 CFR § 1.89. Therefore, Hikvision must submit a written statement concerning this matter within ten (10) days of receipt of this Notice. 47 CFR § 1.89(b). The response must (i) fully explain Hikvision’s rationale, including all relevant surrounding facts, circumstances and supporting documents, for issuing an SDoC for each device identified in Exhibit A when the accompanying test report demonstrated that the device did not comply with applicable Commission rules, (ii) identify any corrective actions that Hikvision is taking to remedy these violations, including a timeline to complete such actions, and (iii) include an updated version of Exhibit A that provides marketing dates in any rows in which the marketing start or ending dates are described as “To be Supplied.” If marketing ceased at any point between the listed marketing start date and the last date of marketing, identify any periods during which Hikvision did not market the device in the United States. The response must be complete and must not be abbreviated by reference to other communications or answers to other notices. 47 CFR § 1.89(c). 5. In accordance with section 1.16 of the Commission’s rules, we direct Hikvision to support its response to this Notice with an affidavit or declaration under penalty of perjury, signed and dated by an authorized officer of Hikvision with personal knowledge of the representations provided in Hikvision’s response, verifying the truth and accuracy of the information therein, and confirming that all of the information requested by this Notice which is in the company’s possession, custody, control, or knowledge has been produced. Section 1.16 of the Commission’s rules provides that “[a]ny document to be filed with the Federal Communications Commission and which is required by any law, rule or other regulation of the United States to be supported, evidenced, established or proved by a written sworn declaration, verification, certificate, statement, oath or affidavit by the person making the same, may be supported, evidenced, established or proved by the unsworn declaration, certification, verification, or statement in writing of such person . . . . Such declaration shall be subscribed by the declarant as true under penalty of perjury, and dated, in substantially the following form . . . : ‘I declare (or certify, verify, or state) under penalty of perjury that the foregoing is true and correct.
