Federal Communications Commission DA 26-453 DA 26-453 Released: May 8, 2026 NOTICE OF PROHIBITED PRESENTATION ET DOCKET NO. 24-136 Notice is hereby given that the Commission received, during the Sunshine Agenda period, a prohibited written presentation in ET Docket No. 24-136 by the party listed in the attached Appendix. With specified exceptions not applicable here, section 1.1203 of the Commission’s Rules, 47 CFR § 1.1203, prohibits the making of any presentation to decision-making personnel concerning any matter listed on the Commission’s Sunshine Agenda, from the day after the Sunshine Agenda is released until the Commission releases the text of a decision or order relating to that matter, or otherwise removes the item from the Sunshine Agenda. The instant presentation addressed the merits of the above-referenced proceeding, which was included on the Commission’s Sunshine Agenda by Public Notice released April 23, 2026, for consideration at the April 30, 2026 open Commission meeting. The Sunshine Agenda period for this item ended May 1, 2026, when the Commission released Promoting the Integrity and Security of Telecommunications Certification Bodies, Measurement Facilities, and the Equipment Authorization Program, ET Docket No. 24-136, Second Report and Order, Order on Reconsideration and Second Further Notice of Proposed Rulemaking (May 1, 2026). During the Sunshine Agenda period, parties seeking to file comments in this proceeding on the Commission’s Electronic Comment Filing System (ECFS) were presented with a notice that stated, “Your filing may be subject to a prohibition at this time. It appears matter(s) in this docket are on the publicly released ‘Sunshine Agenda’ for the Commission’s upcoming open meeting. FCC rules generally prohibit presentations concerning such matters at this time, subject to certain exceptions. For more information, you may visit the ECFS FAQ page.” ECFS required the filer to manually close the notice to proceed, but it did not prevent filing. Under section 1.1212(d) of the Commission’s Rules, 47 CFR § 1.1212(d), presentations that are received during the Sunshine Agenda period and neither meet an exception provided by section 1.1204(a) of the Commission’s Rules, 47 CFR § 1.1204(a), nor are covered by a Commission waiver, shall be associated with, but not made a part of, the record in the relevant proceeding. In accordance with this rule, the presentation listed in the attached Appendix will be associated with, but not made part of, the record in ET Docket No. 24-136.
