DISCUSSION 1. On September 29, 2025, the Wireless Telecommunications Bureau (WTB) and Office of Engineering and Technology (OET) issued an Order conditionally granting the request of the Los Angeles Organizing Committee for the Olympic and Paralympic Games 2028 (LA28) for a Special Temporary Authority (STA) and waiver of certain Commission rules, designed to provide LA28, in partnership with one or more FCC-certified frequency coordinator(s), with enhanced flexibility to facilitate the vital communications needs of the 2028 Olympic and Paralympic Games through primary access to the part 90 Land Mobile Radio spectrum (excluding frequencies dedicated to public safety use) and available part 22 Public Mobile Services spectrum in the VHF and UHF bands. LA28 Request for Special Temporary Authority and Waiver, Order, DA-25-910, 40 FCC Rcd 7542 (2025) (LA28 STA Order). On February 11, 2026, LA28 requested to extend the geographic scope of the STA and waiver to six additional locations for the same purposes as its initial request, and repeated its commitment to work with an FCC-certified frequency coordinator to help facilitate efforts to access available spectrum, work on potential interference issues, and to fine-tune the geographic scope of the request. See ULS File No. 0011903968, Attachment at 1. 2. In our September 29, 2025, Order, and we outlined the reasons that granting LA28’s request for an STA and waiver was in the public interest, subject to the conditions delineated in the September Order. See LA28 STA Order, 40 FCC Rcd at 7545. We hereby find that there continues to be good cause to grant LA28 an STA and waivers to facilitate the communications needs of the 2028 Olympic games, for the same reasons discussed in the September 2025 Order, which we incorporate herein. Id. 3. Thus, we issue to LA28 an expanded STA for Part 90 Land Mobile Radio spectrum and available Part 22 Public Mobile Services spectrum in the UHF and VHF bands, effective March 5, 2028, through September 1, 2028, for the geographic areas referenced in LA28’s ULS application and mentioned below (including areas surrounding Los Angeles and Oklahoma City subject to the existing STA). LA28’s STA application seeks coverage for radiuses of varying mileage around GPS coordinates across the country. The exact geographic parameters of the STA coverage are delineated in LA28’s STA request. See ULS File No. 0011903968, Attachment at 1. Generally, this waiver covers the Table of Frequency Allocations as necessary to repurpose pt. 22 spectrum for PLMR usage, certain pt. 22 licensing requirements and procedures, certain pt. 22 operational and technical requirements, certain pt. 22 paging and radiotelephone service rules, certain pt. 90 industrial/business radio pool rules, certain pt. 90 applications and authorizations, certain pt. 90 policies governing the assignment of frequencies, certain pt. 90 general technical standards, certain pt. 90 standards for special frequencies or frequency bands, certain pt. 90 operating requirements, and certain pt. 90 paging operations rules. 4. Further, as with the September 2025 grant, this grant is subject to the following conditions: (1) The STA and waivers cover only the following spectrum: 72-76 MHz, 150-174 MHz, and 450-512 MHz. (2) The STA and waivers apply only to the geographic areas referenced in LA28’s application and included in the Appendix. See ULS File No. 0011903968, Attachment at 1. (3) For spectrum regulated under part 22 in the above bands, the STA and waiver covers only that spectrum which is available in the Commission’s inventory or that which existing licensees make available to LA28 through contractual arrangements. (4) The STA and waiver cover only private wireless service under part 90. 47 CFR pt. 90. (5) All operations under the STA and waivers must be recommended by an FCC-certified PLMR frequency coordinator. (6) LA28 must ensure that, when recommending operation under the rule waivers above, the frequency coordinator(s) documents good cause and reaches a finding that the potential for harmful interference to other primary licensees is either unlikely, or consent has been obtained; (7) LA28 must maintain control of all operations under the STA, particularly those operations involving a foreign government or representative thereof. (8) Upon receipt of complaints of interference, LA28 must evaluate and attempt to resolve the matter in the first instance and if unable to resolve the issue, forward to the Commission. (9) All radiofrequency transmitting equipment operated under the STA and waivers must be approved via the FCC’s Part 2 Equipment Authorization process. (10) Section 2.106, the Table of Frequency Allocations, is waived only to the extent necessary to use part 22 spectrum for PLMR. II. ORDERING CLAUSES 5. Accordingly, IT IS ORDERED, pursuant to Sections 301, 307, 308, and 309 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 301, 307, 308, 309, and section 1.931 of the Commission’s rules, 47 CFR § 1.931, that the request filed by LA28 for Special Temporary Authority is GRANTED to the extent described, and subject to the conditions specified above. 6. Further, IT IS ORDERED, pursuant to Sections 4(i), 301, 307, 308, and 309 of the Communications Act of 1934, as amended, 47 U.S.C. § 154(i), 301, 307, 308, and 309, and section 1.925 of the Commission’s rules, 47 CFR § 1.925, that the request filed by LA28 for waiver of the Commission’s rules listed in paragraph 3 of this Order is GRANTED to the extent described here, and subject to the conditions described above. 7. This action is taken under delegated authority pursuant to sections 0.131, 0.31, 0.241, and 0.331 of the Commission’s rules, 47 CFR §§ 0.131, 0.31, 0.241, and 0.331.
