Sections 54.719(b), 54.1718(a)(1), and 54.2012(b)(2) of the Commission’s rules provide that any person aggrieved by an action taken by a division of USAC, after first seeking review at USAC, may seek review from the Commission. Sections 54.719(c), 54.1718(a)(3), and 54.2012(a)(3) of the Commission’s rules provide that parties seeking waivers of the Commission’s rules shall seek review directly from the Commission. In this Public Notice, we have reclassified as Requests for Waiver any appeals seeking review of a USAC decision that appropriately should have requested a waiver of the Commission’s rules. Similarly, we have reclassified as Requests for Review any appeals seeking a waiver of the Commission’s rules but that are, in fact, seeking review of a USAC decision. The deadline for filing petitions for reconsideration or applications for review concerning the disposition of any of these Requests is 30 days from the release date of this Public Notice. See 47 CFR §§ 1.106(f), 1.115(d); see also 47 CFR § 1.4(b)(2) (setting forth the method for computing the amount of time within which persons or entities must act in response to deadlines established by the Commission). In denying Cincinnati City School District’s waiver seeking an invoice filing deadline extension, the Commission relied on the Ada School District Order as precedent. See Requests for Waiver of Decisions of the Universal Service Administrator by Ada School District et al.; Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 31 FCC Rcd 3834 (WCB 2016) (Ada School District Order). On reconsideration, the school district argues that the Ada School District Order only applies when parties misunderstand the program requirements. In its case, Cincinnati City School District said it was relying on an audit-related letter that the school district incorrectly interpreted, resulting in its requests for reimbursement not being timely submitted which it argues is distinguishable from Ada School District Order, which was based on a misunderstanding of the E-Rate program requirements. Cincinnati City School District explained that because of the letter, it held off on submitting its requests for reimbursement to USAC. Although the applicant may have chosen to hold off on submitting its requests for reimbursement while the review was underway, the applicant could have timely requested an automatic invoice filing extension request before October 28, 2025 to receive additional time to submit its requests for reimbursement, but Cincinnati City School District did not do so. We uphold our denial and find that Cincinnati City School District failed to demonstrate extraordinary circumstances required to waive section 54. 514(a) and (b). We also find that the Ada School District Order is applicable because it found that “[a]ll of the petitioners could have, but failed to submit timely invoice deadline extension with USAC to receive extra time for filing and reimbursement. . . . In light of the ease with which petitioners could have sought an automatic extension, . . . we find that none of the petitioners demonstrate that they faced special circumstances warranting a deviation from the invoice deadline rules, nor that a deviation from those rules will serve the public interest.” See Ada School District Order, 31 FCC Rcd at 3937, para. 7. We do not find that the Ada School District Order is not limited to only petitioners who misunderstood the E-Rate program rules and find that Cincinnati, like the other petitioners in this Order, could have timely requested an automatic extension of time and failed to do so. We therefore reaffirm our denial of Cincinnati City School District’s waiver and dismiss its petition. Granting On Our Own Reconsideration – Red Light Rule Violation The Wireline Competition Bureau (Bureau) denied Avent Technology Group, Inc.’s appeal in the April 2026 USF Streamlined Public Notice. See Streamlined Resolution of Requests Related to Actions by the Universal Service Administrative Company, CC Docket No. 02-6 et al., Public Notice, DA 26-283 (WCB Apr. 1, 2026) (April 2026 USF Streamlined Public Notice). On our own motion, we now reconsider the Bureau’s denial. See 47 CFR § 1.113(a) (allowing a bureau to set aside or modify its own actions within 30 days). Because the Bureau’s decisions dismissing the waiver and petition were released more than 30 days ago, we waive the section 1.113 requirement that any sua sponte reconsideration of an action taken under delegated authority occur within 30 days of that action. Failing to timely submit invoices does not meet the definition of an invoice clerical or ministerial error, defined as errors one would make on an invoice “when entering data from one list to another, such as mistyping a number, using the wrong name or phone number, failing to enter an item from the source list onto the application, or making an arithmetical error.” See Accomack County Public School Order, 38 FCC Rcd at 332, para. 4. This limited waiver will permit Mercury to pay early a portion of the support recovery it is required to pay due to its decision to default on the authorized Mercury census blocks in certain census block groups in Indiana, Michigan, and Ohio.
