Pursuant to our procedure for resolving requests for review, requests for waiver, and petitions for reconsideration of decisions related to actions taken by the Universal Service Administrative Company (USAC) that are consistent with precedent (collectively, Requests), the Wireline Competition Bureau (Bureau) grants, dismisses, or denies the following Requests. See Streamlined Process for Resolving Requests for Review of Decisions by the Universal Service Administrative Company, CC Docket Nos. 96-45 and 02-6, WC Docket Nos. 02-60, 06-122, 08-71, 10-90, 11-42, and 14-58, Public Notice, 29 FCC Rcd 11094 (WCB 2014).  Section 54.719(b) of the Commission’s rules provide that any person aggrieved by an action taken by a division of USAC, after first seeking review at USAC, may seek review from the Commission.  Sections 54.719(c) of the Commission’s rules provide that parties seeking waivers of the Commission’s rules shall seek review directly from the Commission.  In this Public Notice, we have reclassified as Requests for Waiver any appeals seeking review of a USAC decision that appropriately should have requested a waiver of the Commission’s rules.  Similarly, we have reclassified as Requests for Review any appeals seeking a waiver of the Commission’s rules but that are, in fact, seeking review of a USAC decision.
  The deadline for filing petitions for reconsideration or applications for review concerning the disposition of any of these Requests is 30 days from the release date of this Public Notice. See 47 CFR §§ 1.106(f), 1.115(d); see also 47 CFR § 1.4(b)(2) (setting forth the method for computing the amount of time within which persons or entities must act in response to deadlines established by the Commission).

In their petitions, Nancy Fawcett Memorial Library and Tiffin City School District provide more details about the personnel issues that led to their late-filed FCC Forms 471.  We note, however, that personnel issues, including the absence of key school or board member employees, does not rise to the level of special circumstances required for a waiver of the Commission's rules. In its petition, Stone County School District asks the Bureau to reinstate canceled funding request number 2699014574 and waive the competitive bidding rules for this funding request.  Consistent with precedent, we deny this request and dismiss this petition for reconsideration. Reconsidered On Our Own Motion In the August 2026 USF Streamlined Resolution PN, we granted a waiver of the appeal filing deadline for an appeal filed by Zayo Education LLC and remanded the application back to USAC.  See Streamlined Process for Resolving Requests for Review of Decisions by the Universal Service Administrative Company, CC Docket No. 02-6, WC Docket Nos. 02-60,10-90, 11-42 and 21-450, Public Notice, DA 26-762 (WCB August 2, 2026) (August 2026 USF Streamlined Resolution PN).  We now reconsider that decision on our own motion.  See 47 CFR § 1.113(a).  We find that the waiver of our rules and remand to USAC was not necessary because the appeal was timely filed with the Commission.  See 47 C.F.R. § 54.720 (noting that an affected party requesting review of a USAC decision has 60 days to appeal); 47 C.F.R. § 1.4 (noting that filings can be submitted on the next business day if the deadlines falls on a weekend).  Because we have reconsidered our decision to grant a waiver to Zayo Education LLC and are no longer remanding the application back to USAC, the appeal is again pending with the Commission.

Granted We remand these applications to USAC and direct USAC to complete its review of the applications and issue a funding decision based on a complete review and analysis, no later than 90 calendar days from the release date of this Public Notice.  In remanding these applications to USAC, we make no finding as to the ultimate eligibility of the equipment/services or the petitioners’ applications.  We also waive sections 54.507(d) and 54.514(a) of the Commission’s rules and direct USAC to waive any procedural deadline that might be necessary to effectuate our ruling.  See 47 CFR § 54.507(d) (requiring non-recurring services to be implemented by September 30 following the close of the funding year); 47 CFR § 54.514(a) (codifying the invoice filing deadline rule).

      Services Not Covered by the Applicant’s Competitive Bidding Process We deny Excel’s request to add a second line item to FCC Form 471 261020785, funding request numbers (FRNs) 2699027402 (Cox) and 2699027403 (Verizon).  The establishing FCC Forms 470 do not include the type of service requested on the FCC Form 471.  Further, for FRN 2699027402 (Cox), the establishing FCC Form 470 does not seek service for more than one entity.  We remand to USAC to revise the funding commitments to reflect our findings. This limited waiver will permit Charter to pay early a portion of the support recovery it is required to pay due to its decision to default on the authorized Charter census blocks in certain census block groups in Michigan, Missouri, Oregon, and Wisconsin.
