Federal Communications Commission DA 26-868 DA 26-868 Released: September 1, 2026 STREAMLINED RESOLUTION OF REQUESTS RELATED TO ACTIONS BY THE UNIVERSAL SERVICE ADMINISTRATIVE COMPANY CC Docket No. 02-6 WC Docket Nos. 10-90, 19-126; AU Docket No. 20-34 WC Docket No. 25-127 WC Docket No. 25-187 WC Docket No. 02-60 Pursuant to our procedure for resolving requests for review, requests for waiver, and petitions for reconsideration of decisions related to actions taken by the Universal Service Administrative Company (USAC) that are consistent with precedent (collectively, Requests), the Wireline Competition Bureau (Bureau) grants, dismisses, or denies the following Requests. See Streamlined Process for Resolving Requests for Review of Decisions by the Universal Service Administrative Company, CC Docket Nos. 96-45 and 02-6, WC Docket Nos. 02-60, 06-122, 08-71, 10-90, 11-42, and 14-58, Public Notice, 29 FCC Rcd 11094 (WCB 2014). Section 54.719(b) of the Commission’s rules provide that any person aggrieved by an action taken by a division of USAC, after first seeking review at USAC, may seek review from the Commission. Sections 54.719(c) of the Commission’s rules provide that parties seeking waivers of the Commission’s rules shall seek review directly from the Commission. In this Public Notice, we have reclassified as Requests for Waiver any appeals seeking review of a USAC decision that appropriately should have requested a waiver of the Commission’s rules. Similarly, we have reclassified as Requests for Review any appeals seeking a waiver of the Commission’s rules but that are, in fact, seeking review of a USAC decision. The deadline for filing petitions for reconsideration or applications for review concerning the disposition of any of these Requests is 30 days from the release date of this Public Notice. See 47 CFR §§ 1.106(f), 1.115(d); see also 47 CFR § 1.4(b)(2) (setting forth the method for computing the amount of time within which persons or entities must act in response to deadlines established by the Commission). Schools and Libraries (E-Rate) CC Docket No. 02-6 Dismissed as Moot – USAC Took Requested Action See, e.g., Requests for Review and/or Requests for Waiver of the Decisions of the Universal Service Administrator by Al-Noor High School et al.; Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 27 FCC Rcd 8223, 8224, para. 2 (WCB 2012) (Al-Noor High School Order) (dismissing as moot requests for review where USAC took the action requested by the petitioner). Lincoln Intermediate Unit 12 – LLN, PA, Application No. 221014378, Request for Waiver, CC Docket No. 02-6 (filed Apr. 10, 2026) Dismissed for Failure to Comply with the Commission’s Basic Filing Requirements Dismissing appeal that doesn’t meet the basic filing requirements. 47 CFR § 54.721 (setting forth general filing requirements for requests for review of decisions issued by USAC, including the requirement that the request for review include supporting documentation); see also Wireline Competition Bureau Reminds Parties of Requirements for Request for Review of Decisions by the Universal Service Administrative Company, CC Docket Nos. 96-45, 02-6, WC Docket Nos. 02-60, 06-122, 10-90, 11-42, 13-184, 14- 58, Public Notice, 29 FCC Rcd 13874 (WCB 2014) (reminding parties submitting appeals to the Bureau of the general filing requirements contained in the Commission’s rules which, along with a proper caption and reference to the applicable docket number, require (1) a statement setting forth the party’s interest in the matter presented for review; (2) a full statement of relevant, material facts with supporting affidavits and documentation; (3) the question presented for review, with reference, where appropriate, to the relevant Commission rule, order or statutory provision; and (4) a statement of the relief sought and the relevant statutory or regulatory provision pursuant to which such relief is sought); Universal Service Contribution Methodology; Request for Review by Alternative Phone, Inc. and Request for Waiver, WC Docket No. 06-122, Order, 26 FCC Rcd 6079 (WCB 2011) (dismissing without prejudice a request for review that failed to meet the requirements of section 54.721 of the Commission’s rules). For Washington Elementary School District 6, we note that USAC approved a request for service substitution on March 4, 2026 for FRN 2599024124. Therefore, this request for waiver and/or review may also be moot. Washington Elementary School District 6, AZ, Application No. 251019630, Request for Review and/or Waiver, CC Docket No. 02-6 (filed July 6, 2026) Dismissed and/or Denied Petitions for Reconsideration See, e.g., Requests for Waiver and Review of Decisions of the Universal Service Administrator by Allan Shivers Library et al.; Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 29 FCC Rcd 10356, 10357, para. 2 (WCB 2014) (Allan Shivers Library Order) (dismissing petitions for reconsideration that fail to identify any material error, omission, or reason warranting reconsideration, and rely on arguments that have been fully considered and rejected by the Bureau within the same proceeding). In their petitions, Nancy Fawcett Memorial Library and Tiffin City School District provide more details about the personnel issues that led to their late-filed FCC Forms 471. We note, however, that personnel issues, including the absence of key school or board member employees, does not rise to the level of special circumstances required for a waiver of the Commission's rules. See, e.g., Requests for Waiver by Nederland Independent School District et al., Federal-State Joint Board on Universal Service, Changes to the Board of Directors of the National Exchange Carrier Association, Inc., CC Docket Nos. 96-45 and 97-21, Order, 15 FCC Rcd 19544, 19545, para. 2 (WCB 2002) (Nederland Independent School District Order) (“[W]e have consistently held that personnel disruptions . . . do not rise to the level of special circumstances required for a waiver.”); Requests for Waiver by Fennville Public Schools, Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 19 FCC Rcd 2147, 2148, para. 3 (WCB 2004) (Fennville Public Schools Order) (finding that disruptions related to the reorganization of the organization’s board are not special circumstances warranting a waiver of the filing window). We therefore deny and dismiss these petitions for reconsideration. In its petition, Stone County School District asks the Bureau to reinstate canceled funding request number 2699014574 and waive the competitive bidding rules for this funding request. Consistent with precedent, we deny this request and dismiss this petition for reconsideration. See, e.g., Request for Review of a Decision of the Universal Service Administrator by Le Jardin Academy; Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 29 FCC Rcd 11792, 11793, para. 4 (WCB 2014) (Le Jardin Academy Order) (denying a request to reinstate funding purposefully canceled by the applicant). Burlington Township School District, NJ, Application No. 261042358, Petition for Reconsideration, CC Docket No. 02-6 (filed July 15, 2026) El-Ber Islamic School, NY, Application Nos. 201029005, 201029023, 211024869, Petition for Reconsideration, CC Docket No. 02-6 (filed July 22, 2026) Nancy Fawcett Memorial Library, NE, Application No. 261042415, Petition for Reconsideration, CC Docket No. 02-6 (filed July 31, 2026) St. Matthias Elementary School, WI, Application Nos. 261042269, 261042286, Petition for Reconsideration, CC Docket No. 02-6 (filed June 22, 2026) Stone County School District, MS, Application No. 261042268, Petition for Reconsideration, CC Docket No. 02-6 (filed July 31, 2026) Tiffin City School District, OH, Application No. 261042306, Petition for Reconsideration, CC Docket No. 02-6 (filed July 29, 2026) Reconsidered On Our Own Motion In the August 2026 USF Streamlined Resolution PN, we granted a waiver of the appeal filing deadline for an appeal filed by Zayo Education LLC and remanded the application back to USAC. See Streamlined Process for Resolving Requests for Review of Decisions by the Universal Service Administrative Company, CC Docket No. 02-6, WC Docket Nos. 02-60,10-90, 11-42 and 21-450, Public Notice, DA 26-762 (WCB August 2, 2026) (August 2026 USF Streamlined Resolution PN). We now reconsider that decision on our own motion. See 47 CFR § 1.113(a). We find that the waiver of our rules and remand to USAC was not necessary because the appeal was timely filed with the Commission. See 47 C.F.R. § 54.720 (noting that an affected party requesting review of a USAC decision has 60 days to appeal); 47 C.F.R. § 1.4 (noting that filings can be submitted on the next business day if the deadlines falls on a weekend). Because we have reconsidered our decision to grant a waiver to Zayo Education LLC and are no longer remanding the application back to USAC, the appeal is again pending with the Commission. Zayo Education LLC (Canon City School District RE-1), CO, Application Nos. 231015787, 241013167, 251025733, Request for Waiver, CC Docket No. 02-6 (filed July 13, 2026) Granted We remand these applications to USAC and direct USAC to complete its review of the applications and issue a funding decision based on a complete review and analysis, no later than 90 calendar days from the release date of this Public Notice. In remanding these applications to USAC, we make no finding as to the ultimate eligibility of the equipment/services or the petitioners’ applications. We also waive sections 54.507(d) and 54.514(a) of the Commission’s rules and direct USAC to waive any procedural deadline that might be necessary to effectuate our ruling. See 47 CFR § 54.507(d) (requiring non-recurring services to be implemented by September 30 following the close of the funding year); 47 CFR § 54.514(a) (codifying the invoice filing deadline rule). FCC Form 471 Applications Filed Timely See, e.g., Requests for Waiver and Review of Decisions of the Universal Service Administrator by Academy of Math and Science et al.; Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 25 FCC Rcd 9256, 9259, para. 7 (2010) (Academy of Math and Science Order) (finding that petitioners timely filed their FCC Forms 471 within the relevant FCC Form 471 application filing window). Center For Adolescent Services, Nicholas-Liberty School, OH, Application Nos. 261015423, 261039857, 261014286, 261040015, Request for Waiver, CC Docket No. 02-6 (filed Apr. 15, 2026) Eligible Services See Funding Year 2026 Eligible Services List Order, WC Docket No. 13-184, Order, DA 25-1069, para. 8 (WCB 2025) (Funding Year 2026 Eligible Services List Order) (clarifying that “applicants seeking support for software- or remote-based services as internal connections in funding year 2026 for services that were competitively bid as BMIC services are not violating the competitive bidding rules for this funding year” and directing USAC to apply this decision to pending appeals after the effective date of the Funding Year 2026 Eligible Services List Order). Lamar County School District, MS, Application No. 251041584, Request for Review, CC Docket No. 02-6 (filed Jan. 22, 2026) Late-Filed FCC Form 471 Applications – Due to Circumstances Beyond Their Control See, e.g., Requests for Waiver and Review of Decisions of the Universal Service Administrator by Abbotsford School District et al.; Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 27 FCC Rcd 15299, 15300, para. 2 (WCB 2012) (granting waiver where the applicant filed within a reasonable period after the close of the filing window despite delays beyond its control); Requests for Waiver and Review of Decisions of the Universal Service Administrator by A.C.E. Charter High School et al.; Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 27 FCC Rcd 15907, 15908, para. 2 (WCB 2012) (A.C.E. Charter High School Order) (finding special circumstances existed to justify granting waiver requests where, for example, petitioners filed within a reasonable period of the filing window's close despite a school reorganization). Capital Prep Charter Schools New York, NY, Application Nos. 261042447, 261042446, Request for Waiver, CC Docket No. 02-6 (filed June 15, 2026) Finneytown Local School District, OH, Application No. 261013937, Request for Waiver, CC Docket No. 02-6 (filed July 21, 2026) In addition to waiving the FCC Form 471 application deadline, we waive the 60-day deadline for filing its appeal late with the Commission. See, e.g., ABC Unified School District Order, 26 FCC Rcd at 11019, para. 2 (waiving the appeal and request for waiver filing deadline for petitioners that submitted their requests to the Commission or USAC only a few days late). Montessori del Mundo Charter School, CO, Application No. 261042547, Request for Waiver, CC Docket No. 02-6 (filed July 31, 2026) Montessori del Mundo Charter School, CO, Application No. 261042551, Request for Waiver, CC Docket No. 02-6 (filed July 31, 2026) Late-Filed FCC Form 471 Applications – Filed Within 14 Days of the Close of the Window See, e.g., Academy of Math and Science Order, 25 FCC Rcd at 9259, para. 8 (finding special circumstances existed to justify granting waiver requests where, for example, petitioners filed their FCC Forms 471 within 14 days of the filing window deadline). To the extent that a single party is filing multiple requests for waiver of the application filing window deadline with the same set of facts (e.g., filed within 14 days), the Bureau strongly encourages the party to file a single waiver with a list of application numbers and filing dates attached. The Commission does not require separate appeal and/or waiver submissions in ECFS for each E-Rate FCC Form 471 application number at issue. Avella Area School District, PA, Application No. 261041961, Request for Waiver, CC Docket No. 02-6 (filed June 15, 2026) Bradford Public Library District, IL, Application No. 261041733, Request for Waiver, CC Docket No. 02-6 (filed June 25, 2026) In addition to waiving the FCC Form 471 application deadline, we waive the 60-day deadline for filing its appeal late with the Commission. See, e.g., ABC Unified School District Order, 26 FCC Rcd at 11019, para. 2 (waiving the appeal and request for waiver filing deadline for petitioners that submitted their requests to the Commission or USAC only a few days late). We grant Mastery Charter High School a waiver and direct USAC to conduct a substantive review to determine if additional taxes and fees should have been included on the FCC Form 221026487, funding request number 2299037244. Further, we remand Hickman County School District, One School of the Arts, and Woodland School CUSD 5 appeals to USAC to determine the correct discount rate.  See, e.g., Requests for Waiver and Review of Decisions of the Universal Service Administrator by Ann Arbor Public Schools et al.; Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 25 FCC Rcd 17319, 17320-21, n.5, (WCB 2010) (Ann Arbor Public Schools Order) (explaining that failure to enter an item from the source list onto the application is a ministerial/clerical error that can be permitted correction); Requests for Review of Decisions of the Universal Service Administrator by Archer Public Library et al.; Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 23 FCC Rcd 15518, 15520, n.19 (WCB 2008) (Archer Public Library Order) (permitting correction when applicant’s funding request referenced only 76 of the 181 schools for which it based its request of approximately $46 million in funding; permitting correction when applicant requested the wrong discount that it was eligible for; permitting correction when applicant understated the amount of its recurring charges on its FCC Form 471 application by approximately $11,000). We find that the petitioners were unable to complete implementation for reasons beyond their control and made good faith efforts to comply with Commission rules and procedures. We waive the special construction service delivery deadline and direct USAC to provide Kenowa Hills Public Schools, Las Vegas-Clark County Library District and Sacred Wind Communications, Inc. until June 30, 2027 to complete their special construction projects and direct USAC to provide CENIC-Corporation for Education Network Initiatives in California until September 30, 2026 to complete its special construction project. We also waive any associated administrative or procedural deadlines, including the invoice filing deadline, that might be necessary to effectuate our ruling. See supra note 7. CENIC-Corporation for Education Network Initiatives in California, CA, Application No. 231023227 (Funding Request Nos. 2399031731, 2399031775), Request for Waiver, CC Docket No. 02-6 (filed June 30, 2026) Kenowa Hills Public Schools, MI, Application No. 241032796, Request for Waiver, CC Docket No. 02-6 (filed June 25, 2026) Las Vegas-Clark County Library District, NV, Application No. 231038929, Request for Waiver, CC Docket No. 02-6 (filed June 26, 2026) Sacred Wind Communications, Inc. (Navajo Nation Tribal Consortium), AZ, Application No. 241020552, Request for Waiver, CC Docket No. 02-6 (filed July 1, 2026) The Commission granted a waiver of the Special Construction Service Delivery Deadline to Sacred Wind Communications, Inc. in the June 2026 USF PN. See Streamlined Resolution of Requests Related to Actions by the Universal Service Administrative Company, CC Docket No. 02-6, WC Docket Nos. 23-234, 21-93, 02-60, 06-122, 10-90, 19-126, AU Docket No. 20-34, Public Notice, DA 26-497 (WCB June 1, 2026) (June 2026 USF Streamlined Public Notice). Sacred Wind Communications, Inc. later discovered that that the funding requests cited in the June 2026 USF Streamlined Public Notice had been canceled and replaced with funding request numbers for funding year 2024 under Application No. 241020552. Because the facts, locations and dollar amounts are identical to the waiver granted in the June 2026 USF Streamlined Public Notice, we now grant a waiver of the special construction service delivery deadline for these funding year 2024 funding requests. Denied Late-Filed FCC Form 471 Applications See, e.g., Academy of Math and Science Order, 25 FCC Rcd at 9261-62, para. 13 (denying waivers of the FCC Form 471 application filing window deadline where petitioners failed to present special circumstances justifying a waiver of the Commission’s rules).
