4 FCC Red No. 3 Federal Communications Commission Record DA 89-55 Before the Federal Communications Commission Washington, D.C. 20554 MM Docket No. 88-266 In the Matter of Amendment of Section 73.202(b), Table of Allotments, FM Broadcast Stations. (Grundy Center, Iowa) REPORT AND ORDER (Proceeding Terminated) RM-6069 Adopted: January 18, 1989; Released: February 2, 1989 By the Deputy Chief, Policy and Rules Division: 1. At the request of Stoner Broadcasting System, Inc. (petitioner), the Commission has before it the Notice of Proposed Rule Making and Order to Show Cause, 3 FCC Red 3965 ( 1988), proposing the substitution of Channel 241A for Channel 249A at Grundy Center, Iowa, and the modification of the license of Grundy Broadcasting Com pany (Grundy Broadcasting) for Station KGGI(FM) to specify the alternate Class A channel. Petitioner requested the substitution of channels at Grundy Center so as to eliminate a short-spacing problem between its Station KHAK-FM at Cedar Rapids, Iowa, and the Grundy Center station arising from Station KHAK-FM's application for a construction permit to relocate its transmitter site. Com ments were filed by Grundy Broadcasting and jointly by petitioner and Quass Broadcasting Company (Quass), fu ture licensee of Station KHAK-FM at Cedar Rapids. Iowa. Reply comments were filed jointly by petitioner and Ouass. 2. On November 1, 1988, petitioner filed a request for the withdrawal of its rule making request. It states that it has sold Station KHAK-FM to Quass and Quass has deter mined that it does not desire to proceed with the applica tion to relocate the station's transmitter. To this end, Quass has requested dismissal of the application. There fore, petitioner states that the relief requested in the rule making is now moot. 3. Based on the above information, we will grant peti tioner's request for the dismissal of its rule making pro posal. Accordingly, IT IS ORDERED, That the petition for rule making submitted by Stoner Broadcasting System (RM-6069) IS DISMISSED. 4. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 5.
