We now address a Petition for Reconsideration filed by Value Radio Corporation ("Value") seeking reconsider ation of the Commission's action amending the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, 47 C.F.R. ยง73.202(b), to substitute Channel 292C2 for Channel 272A at Stephenson, Michigan. See Report and Order in MM Docket No. 89-500, 6 FCC Red 2142 (1991). Essentially, Value requests that the Commission set aside the amendment to the FM Table of Allotments in order to reconsider its proposal to allot Channel 272C2 to Stephen- son rather than Channel 292C2 to accommodate, among other things, its upgrade proposal for its station, WMGV(FM), then operating on Channel 280A at Osh- kosh, Wisconsin. 1 WinCom Wisconsin Limited Partnership ("WinCom") filed an opposition to the petition for reconsi deration supporting the Commission's action in MM Dock et No. 89-500. 2. Subsequent to the filing of the petition for reconsideration, the Commission issued a Report and Order in MM Docket No. 90-139, DA 95-224 (released February 21, 1995) which, among other things, effectuated Value's proposal. Channel 280C3 was substituted for Channel 280A at Oshkosh, Wisconsin; Channel 280C3 was reallotted from Oshkosh to Winneconne, Wisconsin; and the license for Station WMGV(FM) was modified to specify operation on Channel 280C3 at Winneconne. In addition, the alleged conflict between the allotment of Channel 292C2 at Ste phenson and the use of Channel 291C3 in MM Docket No. 90-139 no longer exists.2 Therefore, in light of this action Douglas W. Value, a co-petitioner in MM Docket No. 90-139, proposed the substitution of Channel 280C3 for Channel 280A at Oshkosh, Wisconsin; the reallotment of Channel 280C3 from Oshkosh to Winneconne, Wisconsin; and the modification of the license for Station WMGV(FM) to speci fy operation on Channel 280C3 at Winneconne. In its petition, Value states that the allotment of Channel 292C2, rather than Channel 272C2, at Stephenson effectively precludes its Osh- kosh/Winneconne proposal. 2 In MM Docket No. 90-139, Value suggested the allotment of Channel 291C3 to Townsend, Wisconsin, as an alternative chan nel to resolve a conflict between the mutually exclusive propos als in that proceeding. However, the need to use an alternative channel was obviated by the voluntary withdrawal of the coun terproposal for an allotment at Townsend.
