1. Before the Commission for consideration is the Notice of Proposed Rule Making, 
11 FCC Red 7019 (1996), issued in response to a petition for rule making filed on behalf of 
Tehachapi Broadcasting ("petitioner") proposing the allotment of Channel 261A to Tehachapi, 
California, as that community's second local FM service. Petitioner filed supporting comments 
in response to the Notice stating its intention to apply for Channel 261A if it is alloted to 
Tehachapi, as requested. No other comments were received.
2. In view of the interest expressed in providing a second local FM service to Tehachapi, 
California, we will allot Channel 261A to that community, as requested.
3. As reported in the Notice, Channel 261A can be allotted to Tehachapi in conformity 
with the minimum distance separation requirements specified in Section 73.207(b)(l) and (3) of 
the Commission's Rules, provided the transmitter therefor is sited at least 13.7 kilometers (8.5 
miles) northeast of the community at coordinates North Latitude 35-13-04 and West Longitude 
118-20-37. Additionally, as Tehachapi is located within 320 kilometers (199 miles) of the United 
States-Mexico border, concurrence of the Mexican government to this proposal was obtained.
4. Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(l), 303(g) and 
(r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61,0.204(b) and 
0.283 of the Commission's Rules, IT IS ORDERED, That effective December 2, 1996, the FM 
Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED with respect 
to Tehachapi, California, as follows:

5. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED.
6. The window period for filing applications for Channel 261A at Tehachapi, California, 
will open on December 2, 1996, and close on January 2, 1997.
