DA 96-1 Federal Communications Commission Record Before the Federal Communications Commission Washington, D:C. 20554 PUBLIC NOTICE Released: January 5, 1996 11 FCC Red Ni FCC ANNOUNCES PROCEDURES FOR THE FILING OF DOCUMENTS THAT WERE DUE DURING THE GOVERN· MENT SHUTDOWN In order to facilitate the orderly reopening of the Federal Communications ComJ.llission, the· Office of the Secretary will accept the filing of .documents that were due to be filed with the Commission· during the Governrrtent shutdown according to' the following procedures: • All documents that were due to be filed with the Commission (at its headquarters, Gettysburg, PA, or Mellon Bank) while ii was closed will be due no later than 5:30 p.m. on the second business day after the Commission reopens. To this extent, Section 1.4U) of the Commission's rules, 47 C.F.R. § 1.40), which would otherwise require such filings on the firs"t busi ness day after the shutdown, IS HEB-EBY WAIVED. While parties will have two business days to f1le at the appropriate location once the agency is. reopened for business, they are strongly encouraged to tender their documents for filing as early as possible: • Unless otherwise announced,. the FCC Headquar ters building and the Secretary's office will be open at 8:00 a.m. -on the first day ·the Commission is. authorized to reopen for business, and will be closed at 5:30 ·p.m. The Secretary will not accept documenis after 5:30 p.m. Therefore, while persons will be ad mitted to the building before 5:30 p.m., due to the anticipated volume qf filings, they may hot be able ·to file documents with the Secretary after 5:30 p.m. See 47 C.F.R. § 1.4(1). Filings at the Commission's Get tysburg facility and at the Mellqn Bank will also be accepted during normal business hours during the first two business days after the Commission isau~ thorized to reopen. • Documents received during. the Government shutdown via mail at the Commission's headquarters, at Melion Bank or at the Commission's Gettysburg. offices will be deemed filed on the first day that the Commission is authorized to reopen. This Public Notice affects only due dates for fili"ngs with the Commission that were due during the shutdown. It does not affec;t due dates for the filing of documents due to be filed after the Commission reopens and does not affect the effective dates of Commission actions or other events.
