Federal Communications Commission DA 96-2201 Before the FEDERAL COMMUNICATIONS COMMISSION Washington, D.C. 20554 In the Matter of ) ALLNET COMMUNICATION SERVICES, INC., ) Complainant, ) File No. E-92-98 v. ) SOUTHERN NEW ENGLAND TELEPHONE CO., ) Defendant. ) ORDER Adopted: December 31, 1996; Released: January 3, 1997 By the Chief, Formal Complaints and Investigations Branch, Enforcement Division, Common Carrier Bureau: 1. On July 1, 1992, Allnet Communication Services, Inc. ("Allnet") filed the above- captioned complaint against Southern New England Telephone Co. ("SNET"). In its complaint, Allnet alleged, inter alia, that SNET violated the Communications Act of 1934, as amended, as well as SNET's interstate tariffs and the Commission's equal access policies by refusing to provide Allnet with voice grade Feature Group D (FGD) connections to SNET end offices. On December 23, 1996, Allnet, now known as Frontier Communications Services, Inc. ("Frontier"), submitted a letter withdrawing its Complaint. 2. We are satisfied that the withdrawal will serve the public interest by eliminating the need for further litigation and the further expenditure of resources by the parties and the Commission. 3. Accordingly, IT IS ORDERED pursuant to Section 4(i) and 4(j) of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i), 154(j), and the authority delegated by Section 0.291 of the Commission's rules, 47 C.F.R. § 0.291, that Frontier's Complaint is HEREBY WITHDRAWN. 1763 Federal Communications Commission DA 96-2201 4.
