January 19, 1996 WIRELESS TELECOMMUNICATIONS BUREAU SEEKS COMMENT ON BELL ATLANTIC NYNEX MOBILE INC.'S REQUEST FOR WAIVER OF SECTION 22.903 OF THE COMMISSION'S RULES On January 16, 1996, Bell Atlantic NYNEX Mobile, Inc. ("BANM"), managing general partner of Cellco Partnership, which directly or indirectly controls cellular licenses in markets throughout the United States, sought a waiver of Section 22.903 of the Commission's rules, 47 C.F.R. § 22.903. The waiver would permit BANM to provide integrated competitive landline local exchange ("CLLE") services outside the Bell Atlantic Corporation and NYNEX Corporation regions. BANM asserts that the requested waiver is identical to one granted by the Commission to Southwestern Bell Mobile Systems ("SBMS"), CWD-95-5, Memorandum Opinion and Order, FCC 95-436, rel. October 25, 1995. BANM notes that the waiver would be conditioned on two requirements: (1) BANM (or any other affiliate providing integrated cellular and CLLE services) wUl be fully separated from the Bell Atlantic and NYNEX LECs; and (2) BANM cannot offer services in the Bell Atlantic and NYNEX regions. The Wireless Telecommunications Bureau is reviewing BANM's request to determine whether it meets the waiver criteria set forth in Sections 1.3 and 22.119 of the Commission's rules and whether the request is consistent with the Commission's public interest goals. In addition, we seek comment on BANM's claim that the issues raised by its waiver request are identical to those addressed in the Southwestern Bell Mobile Systems waiver order.
