PETITION FOR EXPEDITED DECLARATORY RULING

On May 10, 1996, the Public Utility.Commission of Texas (Texas PUCT), through the 
Office of the Attorney General of Texas, filed a petition for expedited declaratory ruling. 
The Texas PUCT requests that the Federal Commission Communications declare whether 
certain provision of the Texas Public Regulatory Act of 1995 violate sections 253(a) and (b) 
of the Telecommunications Act of 1996 and are thereby preempted.
Interested parties should file comments on the Texas PUCT petition by June 
14, 1996, and reply comments by July 1, 1996, with the Secretary, FCC, 1919 M Street, 
N.W., Washington, D.C. 20554. A copy should also be sent to Janice Myles, Common 
Carrier Bureau, FCC, Room 544, 1919 M Street, N.W., Washington, D.C. 20554, and to the 
Commission's contractor for public service records duplication, ITS, Inc., 2100 M Street, 
N.W., Suite 140, Washington, D.C. 20037. Parties filing comments in this non-docketed 
proceeding should include the Policy Division internal reference number, CCBPol 96-13 on 
their pleadings. The Texas PUCT petition is available for inspection and copying in the 
Common Carrier Bureau's Public Reference Room, Room 509, 1919 M Street, N.W.,
