Before the Commission for consideration is the Notice of Proposed Rule .Making, (Notice), 12 FCC Red 704 (1997), issued in response to a petition for rule making filed by Homedale Broadcasting Company ("petitioner''), proposing the allotment of Channel 292C to Homedale, Idaho, as that comnnmity's first local aural 1Iansmission service. Petitioner filed ~ring comments in response to the Notice. No other comments were received. 2. In view of the interest ~ in providing a first local aural transmission service to Homedale, Idaho, we will allot Channel 292C to that community, as requested. 3. As stated in the Notice, Channel 292C can be allotted to the incorporated . community of Homedale consistent with the minimum distance separation requirements of Section 73.207(b XI) of the Commission's Rules, provided the 1Iansmitter is sited at l~ 35.9 kilometers (22.3 miles) west of the community, utilizing coordinates 43-43-13 and 117-22-10.1 4. Accordingly, pursuant to the authority contained in Sections 4(i), 5(cXl), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective July 7, 1997, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED to include Homedale, Idaho, as follows: Channel No. Homedale, Idaho 292C 1 As stated in the Notice, the site restriction is required to avoid a short spacing to the licensed site of Station KCIX(FM), Channel 290C, Garden City, Idaho, at coordinates 43-45-18 and 116-05-52. 6553 Federal Communications Commission DA 97-1042 5.
