BOCs' Petition for Forbearance
of Section 203(c)(2) of the Communications Act
To Issue SMS/800 Refund

On June 11, 1997, the Commission released a Public Notice with regard to the 
Bell Operating Companies1 (BOCs) Petition for Forbearance pursuant to Section 10 of the 
Communications Act of 1934, as amended (Communications Act) (47 U.S.C. 160). The 
BOCs request the Commission to forbear from applying Section 203(c)(2) of the 
Communications Act, to allow the BOCs to issue a one-time refund of certain revenues 
received pursuant to the SMS/800 Functions Tariff.
This is a non-restricted proceeding. Ex parte communications are subject to the permit 
but disclose rules, set forth in 47 C.F.R. section 1.1206.
