No. 97-99 ORDER Adopted: July 3, 1997 Released: July 3, 1997 By the Chief, International Bureau: 1. On June 26, 1997, Digital Services Corporation, Microwave Services, Inc., and Teligent, L.L.C. (formerly Associated Communications L.L.C.)(collectively, the "DBMS Licensees") petitioned the Commission to exceed the 25-page limitation that normally governs oppositions to petitions for reconsideration of Commission orders. 47 C.F.R. § 1.429(f). 2. DBMS Licensees state that they intend to file a consolidated response to the petitions for reconsideration and petition for clarification as many of the arguments raised in these petitions are similar and can be addressed in a single filing. Because of the number of DBMS licensees and the complexity of the issues involved, the DBMS Licensees seek a waiver of the page limit. 3. Although the Commission does not routinely grant waivers of the page limit we agree with the OEMS Licensees that the public interest would be more adequately served if they are permitted to consolidate their filing and exceed the page limit. Specifically, we find that because of the complexity of the issues involved and the fact that the DBMS Licensees are consolidating their responses to issues raised, this will eliminate the need for duplicative pleadings, reduce the burden on all parties to the proceeding, and conserve Commission resources. 9723 4. This action is taken pursuant to authority' found in Sections 4(i) and 303 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i) and 303; and pursuant to Sections 0.5], 0.261 and 1.48 of the Commission's Rules, 47 C.F.R. §§ 0.51, 0.261 and 1.48. Accordingly, IT IS "ORDERED that the OEMS Licensees may exceed the 25-page limitation in a consolidated opposition to petitions for reconsideration or clarification filed in the above captioned proceeding.
