AND PCS DEVELOPMENT CORPORATION, AND GRANTS RESPECTIVE 900 MHz SMR LICENSES On April 29, 1996 Mobile Relay Associates, Inc. filed an application for 900 MHz Specialized Mobile Radio ("SMR") Metropolitan Trading Area ("MTA") License, Block P, MTA M022, Denver, CO, ("Application"). By Public Notice, the Commission accepted the Application for filing on May 20, 1996. On June 19, 1996, PCS Development Corporation, (now known as CONXUS Communications, Inc.) the parent and sole shareholder of SGI Communications, Inc. filed a Petition to Deny against the Application. A Joint Request for Approval to Dismiss with Prejudice, a copy of the written agreement, and declarations have been reviewed and are hereby approved pursuant to Section 90.162 of the Commission's rules, 47 C.F.R. § 90.162. The Commercial Wireless Division ("Division") has reviewed the Petition to Deny and finds that it raises no substantial or material questions of fact under 47 U.S.C. § 309. Accordingly, the Division dismisses the Petition to Deny, finds that the application is in the public interest and has granted the application effective February 14, 1997.
