Hartenstein, President DIRECTV Enterprises, Inc. 2230 East Imperial Highway El Segundo, California 90245 Dear Mr. Hartenstein: This is in response to your May 5, 1999 request to conform the license terms for direct broadcast satellites ("DBS") DBS-1 and DBS-2 (File No. DBS 84-02) to the Commission's ten-year direct broadcast license term. These licenses were granted before the rules changing the DBS service license terms from five to ten years were adopted. See Revision of Rules and Policies for the Direct Broadcast Satellite Service, Report and Order, 11 FCC Red 9712, 9762 (1995); 47 C.F.R. § 100.17(a). DIRECTV states that this ministerial action will create parity between the non- broadcast licenses to cover constructed DBS facilities before the license term was revised, in December 1995. with those granted after the revision. In addition, DIRECTV states that this action will implement the Commission's revised non-broadcast license term to coincide with the longer operational lifespan of DBS satellites and provide DIRECTV with increased certainty in order to plan and invest in its DBS infrastructure. We find that this action is in the public interest. Therefore, pursuant to authority delegated by Sections 0.261 and 100.17(a) of the Commission's Rules, 47 C.F.R. §§ 0.261, 100.17(a), DIRECTV's request to conform the DBS-1 and DBS-2 direct broadcast satellite licenses IS GRANTED. The revised license expiration dates for the satellites in question are as follows: DBS-1 - June 4, 2004; DBS-2 - May 2, 2005. This action also covers the license term for the five channels at 101 W.L. (File Nos. DBS 81-07/94-04L and DBS 81-07(II)/94-06L) previously licensed to USSB II, Inc., a 7469 wholly-owned subsidiary of United States Satellite Broadcasting Company, Inc. USSB is authorized to assign these channels to DIRECTV pursuant to United States Satellite Broadcasting and DirecTV Enterprises, Inc., Order and Authorization, DA 99-633 (Int'l Bureau, April 1, 1999).
