SAT- A/ O- 20000119- 00002 through SAT- A/ O- 20000119- 00018; SAT- AMD- 20000119- 00029 through SAT- AMD- 20000119- 00041; SAT- LOA- 20000119- 00019 through SAT- LOA- 20000119- 00028 The Commission has received a supplemental filing from Intelsat LLC that (1) describes the International Telecommunications Satellite Organization’s (“ INTELSAT’s”) planned privatization as approved by the INTELSAT Assembly of Parties and Board of Governors and (2) states that INTELSAT will privatize in a manner consistent with Section 621 and 622 of the Open- Market Reorganization for the Betterment of International Telecommunications Act (Pub. Law 106- 180 114 Stat. 48 (2000) (the “ORBIT Act”). The Commission required that Intelsat LLC make this supplemental filing within 15 days after the conclusion of the 25 th Assembly of Parties in Memorandum Opinion Order and Authorization in Intelsat LLC, FCC 00- 287 (Aug. 2, 2000) (“ Intelsat LLC Order”), aff’d on reconsideration FCC 00- 437 (Dec. 14, 200) (granting Intelsat LLC licenses (i) to operate 17 existing C- band and Ku- band satellites presently owned and operated by INTELSAT, (ii) to construct, launch and operate 10 satellites planned by INTELSAT for operation in these bands, and (iii) to relocate, among 22 orbit locations, certain currently operating satellites upon the launch of the10 planned satellites). The International Bureau granted Intelsat LLC an extension of this deadline until December 18, 2000 so that further privatization decisions made by the INTELSAT Board of Governors could be included in Intelsat LLC’s supplemental filing. Intelsat LLC meets the ORBIT Act’s definition of a successor entity. Intelsat LLC states that (1) INTELSAT is irrevocably committed to a full privatization through the transfer of all its operating assets to an independent successor entity; and (2) INTELSAT’s independent successor entity will function consistently with the ORBIT Act’s pro- competitive criteria. Intelsat LLC contends that no additional FCC proceedings looking toward restrictions on Intelsat LLC’s license or access to U. S. markets are required by the ORBIT Act or warranted by the public interest. COMMENTS may be filed on or before January 23, 2001. REPLIES may be filed on or before February 2, 2001. RESPONSES to replies may be filed on or before February 7, 2001. The Bureau previously determined to treat this matter as a “permit- but- disclose” proceeding in accordance with the Commission’s ex parte rules. See 47 C. F. R. §§ 1.1200, 1.1206 (Report No. SAT- 00035, February 2, 2000). Persons making oral ex parte presentations are reminded that memoranda summarizing the presentations must contain summaries of the substance of the presentations and not merely a listing of the subjects discussed. More 1 2 than a one or two sentence description of the views and arguments presented is generally required. See 47 C. F. R. § 1.1206( b). Other rules pertaining to oral and written ex parte presentations in permit- but- disclose proceedings are set forth in Section 1.1.206( b) of the Commission’s rules, 47 C. F. R. § 1.1206( b). Commenters must file an original and four copies of all comments, replies and responses.
