FOR IMMEDIATE RELEASE: News Media Contact: March 14, 2001 Michelle Russo (202) 418- 2358 FCC RELEASES ORDER DENYING PETITION TO RECONSIDER APPROVAL OF AT& T AND MEDIAONE MERGER Action Does Not Address Issues on Remand from Appeals Court Case Washington, D. C. – The Federal Communications Commission (FCC) today released an Order on Reconsideration denying a petition that the FCC reconsider its decision to approve the transfer of control of licenses and authorizations from MediaOne Group, Inc. (MediaOne) to AT& T Corporation (AT& T). On June 5, 2000, the FCC determined that the merger between AT& T and MediaOne serves the public interest by facilitating the provision of local telephony and new advanced technologies and services, and thus approved the applications. The Consumers Union, the Consumer Federation of America and Media Access Project jointly filed a Petition for Reconsideration. The FCC rejected the petitioners’ arguments and denied the petition for reconsideration. Today’s order was adopted by the FCC on February 8, 2001. Since that time, the U. S. Court of Appeals for the D. C. Circuit issued its opinion in Time Warner Entertainment Co. v. FCC (No. 94- 1035, March 2, 2001) and remanded the FCC’s limits on cable horizontal ownership and affiliated programming. This order on reconsideration does not address any of the issues presented to the FCC in the court’s remand. Action by the Commission, February 8, 2001 by Order on Reconsideration (FCC 01- 47).
