(EMBRATEL) Petition for Declaratory Ruling On January 16, 2001, the Satellite and Radiocommunication Division of the International Bureau (Division) added the Brasilsat A2 satellite, operated by Empresa Brasileira de Telecomicaçöes S. A. (Embratel) to the Permitted Space Station List. See Empresa Brasileira de Telecomicaçöes S. A., Petition for Declaratory Ruling on Access to Brasilsat A2 Satellite via U. S. Earth Stations, Order, DA 00- 2878 (Sat. and Rad. Div., Int'l Bur., released Jan. 16, 2001) (Embratel Permitted List Order). On March 1, 2001, Embratel informed us that 19.9 percent of its company was purchased by Société Européenne des Satellites S. A., and was renamed "STAR ONE S. A." Letter from Alfred M. Petition for Declaratory Ruling Page 1 of 2 1 In 1999, the Commission adopted the New Skies Market Access Order, which granted authority under the DISCO II framework to 136 earth stations to communicate with one or more of five satellites currently operated by New Skies Satellites, N. V. (New Skies), subject to conditions, for three years after the release date of the that Order. See New Skies Satellites, N. V., Order and Authorization, 14 FCC Rcd 13003 (1999) (New Skies Market Access Order). On October 31, 2000, New Skies requested the Commission to extend the 136 earth station authorizations to full ten- year terms, and to waive the conditions placed on those earth station authorizations. File No. SAT- PDR- 20001031- 00146. In that context, New Skies also stated that it was planning to launch NSS- 7 in 2002, and requested us not to impose a non- interference condition on NSS- 7. Thus, New Skies has requested authority to use NSS- 7 to provide service to the United States. We will treat this request as a petition for declaratory ruling to place NSS- 7 on the Permitted Space Station List. The Permitted Space Station List denotes all satellites with which U. S. earth stations with "routinely" authorized technical parameters are permitted to communicate without additional Commission action, provided that those communications fall within the same technical parameters and conditions established in the earth stations' licenses. Special Temporary Authority PanAmSat Corporation has filed an application for Special Temporary Authority to relocate PAS- 9 from 58° W. L to 155.5° W. L., and to operate the C- band and Ku- band payloads on the satellite at that orbital location, for up to 180 days. Comments may be filed on or before April 2, 2001.
