 The  applications  listed  below  have  been  found,  upon  initial  review,  to  be  acceptable  for  filing.  These  applications  are  not  subject  to  the  streamlined  processing  procedures  set  forth  in  Section  63.12  of  the  Commission’s  rules,  47  C.  F.  R.  §  63.12. 
 These  applications  shall  not  be  deemed  granted  until  the  Commission  affirmatively  acts  upon  the  application,  either  by  public  notice  or  by  written  order.  Operation  for  which  authorization  is  sought  may  not  commence  except  in  accordance 
 with  any  terms  or  conditions  imposed  by  the  Commission.

 Petition  for  Declaratory  Ruling 
 Petition  filed  by  Pacific  Lightnet,  Inc.  (Pacific  Lightnet)  to  exceed  the  25%  indirect  foreign  ownership  benchmark  in  section 
 310(  b)(  4)  of  the  Communications  Act  of  1934,  as  amended.  This  request  is  filed  in  connection  with  several  applications  to  assign 
 certain  common  carrier  point-  to-  point  microwave  licenses  from  Pacwest  Network  Hawaii,  Inc.  to  Pacific  Lightnet.  See  File  No. 
 0000422346,  Public  Notice  Report  No.  853,  released  May  9,  2001.  Petitioner  states  that  Tomen  Corporation  (Tomen),  a  company 
 organized  under  the  laws  of  Japan  and  having  its  principal  place  of  business  in  Japan,  a  WTO  Member,  holds  a  50%  indirect  interest  in 
 Pacific  Lightnet.  Action  on  this  petition  is  without  prejudice  to  Commission  action  on  the  underlying  Title  III  assignment  application. 
 Interested  parties  may  file  comments  by  August  3,  2001,  and  reply  comments  by  August  10,  2001.
