These modifications would have permitted Ameritech Communications Services, Inc., a wholly- owned subsidiary of Ameritech Communications, Inc., to offer competitive local exchange service in four market areas of Ohio that are served by non- Ameritech incumbent local exchange carriers (ILECs). The market proposed to served are: Cincinnati, (to include the Cincinnati exchange area that is currently served by Cincinnati Bell); Lebanon/ Mason, (to include the Lebanon and Mason exchange areas northeast of Cincinnati that are currently served by United/ Sprint); Hudson/ Twinsburg, (to include the Hudson, Twinsburg and Northfield exchange areas south of Cleveland that are currently served by Western Reserve/ ALLTEL); and Delaware, (to include the Delaware and Cheshire Center exchange areas north of Columbus that are currently served by GTE). On April 10, 2000, Ameritech filed an amendment to its November 24, 1999 petition. The amendment stated that SBC Telecom, Inc. (“ SBC Telecom”), a wholly owned- owned subsidiary of SBC Communicat ions Inc., would assume the responsibilit y for the services cont emplat ed to be provided in the Cincinnati and Lebanon, Ohio markets, and that ACSI would remain as the applicant to provide local exchange service in the Hudson and Delaware, Ohio markets. On September 6, 2001, Ameritech withdrew its November 24, 1999 petition. In its place, SBC Telecom has submitted a petition requesting that it be able to serve the four areas listed in the November 24, 1999, petition and that it be able to provide local service on the same geographic basis as the ILECs that serve those four areas. SBC Telecom also seeks to provide service that is not limited to flat- rated service, i. e. it may provide measured- rated or message- rated service as competition warrants. Additionally, SBC Telecom proposes an expedited process for securing Commission approval of future LATA modifications. Under the proposal, if the Public Utilities Commission of Ohio (PUCO) expands an ILEC’s local calling area, SBC Telecom would file a petition with the Commission seeking a LATA modification that would enable SBC Telecom to mirror the ILEC 1 expansion. If, however, within 30 days of the Commission placing the petition on Public Notice no part y files opposing comment s, the Commission will grant the modificat ion on the 30 th day. We seek comment on SBC Telecom’s September 6, 2001 petition as well as its proposal for expedited LATA review. Although not requested by SBC Telecom, we also seek comment on whether the proposed expedited review for LATA modifications could also apply to the Commission’s procedures for review of traditional flat- rated, non- optional petitions for expanded local calling service (ELCS) filed by Bell Operating Companies, as set forth in Petitions for Limited Modification of LATA Boundaries to Provide Expanded Local Calling Service (ELCS) at Various Locations, Memorandum Opinion and Order, 12 FCC Rcd 10646 (1997). Interested parties may file comments concerning this matter on or before November 22, 2001 and reply comments on or before December 6, 2001.
