Washington, D. C. -- Today the Federal Communications Commission released an Order on Review (Order) holding SBC Communications Inc. (SBC) liable for a fine of $84,000 for 24 violations of the Commission's collocation rules. The Order affirms an Order of Forfeiture issued by the Enforcement Bureau on May 24, 2001 (DA01- 1273). The rule at issue requires incumbent local exchange carriers (ILECs) to post within 10 days, on their publicly available Internet site, notices of ILEC- owned premises that have run out of collocation space. An independent audit of SBC's compliance with the Commission's collocation posting rules uncovered violations and the Enforcement Bureau's subsequent investigation revealed additional violations. In today’s action, the Commission rejected several defenses that SBC asserted in its Application for Review of the Order of Forfeiture but removed from the forfeiture three additional violations due to possible statute of limitation issues, which reduced the amount from $94,500.
