On April 25, 2002, SES AMERICOM, Inc. filed a Petition for Declaratory Ruling to serve the U. S. market using BSS spectrum from the 105.5º W. L. orbital location. SES AMERICOM requests that the Commission find it in the public interest for SES AMERICOM to offer satellite capacity for third party direct- to- home services to consumers in the United States and certain British Overseas Territories in the Caribbean. SES AMERICOM will offer capacity on a satellite licensed by the Government of Gibraltar. SES plans to use the 12.2- 12.7 GHz downlink frequency bands and the 17.3- 17.8 GHz feeder link frequency bands that have been allocated and are currently used in the Region 2 (including the United States) for direct broadcast satellite service. In addition, SES AMERICOM requested a waiver of the rule requiring DBS operators to provide DBS service to Alaska and Hawaii. Comments may be filed on or before June 17, 2002.
