Consistent with Section 8( b), the Commission will make adjustment to reflect changes in the cost- of- living increases in the Consumer Price Index- Urban (CPI- U) as of October 1, 2001. The cost- of- living adjustments are made pursuant to Section 8( b) of the Communications Act of 1934, as amended in the Omnibus Budget Reconciliation Act of 1989. The Act allows for adjustments to the fee schedule every two years after October 1, 1991. Increases in the dollar amounts under the cost- of- living adjustments apply to all fees based on the percentage change in the CPI- U from the date of enactment of the legislation. The new Schedule of Charges will reflect the net change in the CPI- U of 40 percent, calculated from December 1989 through October 2001 in accordance with the Section 1.115 of Part 1 of the Commission’s rules. All revenues generated by this fee collection program are deposited in the general fund of Treasury.
