Petition for Declaratory Ruling Glentel Corp. (Glentel or Applicant) requests that the Commission find permissible indirect foreign ownership of Glentel in excess of the 25 percent benchmark of Section 310( b)( 4) of the Communications Act of 1934, as amended. This request is filed in connection with an application for blanket authorization to operate up to 50,000 mobile earth station terminals. See FCC File No. SES- LIC- 20030502- 00572, listed as accepted for filing in Public Notice, Report No. SES- 00495 (May 7, 2003). Applicant states that, Glentel, a U. S. corporation, is wholly owned by Glentel U. S. Corp. (Glentel US), a U. S. corporation. According to Applicant, Glentel U. S. is in turn wholly owned by Glentel Inc., a Canadian corporation, whose shares are owned by Canadian nationals. Applicant asserts that, pursuant to the rules and policies established in the Commission's Foreign Participation Order, 12 FCC Rcd 23891 (1997), Order on Reconsideration, 15 FCC Rcd 18158 (2000), the "home market" of Glentel Inc. is Canada, which is a Member of the World Trade Organization.
