ADELSTEIN Re: Application by Qwest Communications International, Inc., for Authorization to Provide In- Region, InterLATA Services in Minnesota (WC Docket No. 03- 90) Today we grant Qwest authority to provide in- region, interLATA service originating in the state of Minnesota. I approve this Order and commend the Minnesota Public Utilities Commission and our Wireline Competition Bureau for all of their hard work. I also congratulate Qwest on achieving this goal. Although I approve authorization for Qwest to provide in- region, interLATA services in Minnesota, I must express concern about the previously unfiled agreements that have been brought to our attention in this proceeding. The Telecommunications Act anticipated transparency in the relationships between the competitive LECs and the ILECs. If we don’t know what arrangements are being made among the carriers for the purposes of interconnection, we do not have the transparency that is integral to one of the purposes of the Act. Section 271( d)( 6) of the Communications Act is meant to ensure that each carrier that is granted Section 271 approval continues to satisfy the requirements on which such approval is based. We will not be reticent about using our enforcement authority to ensure that all carriers remain compliant. 1
