The Commission reserves the right to return any of the applications if, upon further examination, it is determined the application is not in conformance with the Commission's rules or its policies. Petitions, oppositions and other pleadings filed in response to this notice should conform to Section 25.154 of the Commission's rules, unless otherwise noted. 47 C. F. R. § 25.154. Processing of the applications captioned above would generally proceed on a restricted basis under the Commission's ex parte rules. See 47 C. F. R. §§ 1.1202( d) and 1.1208. Because these applications present complex, interrelated legal, technical and policy issues associated with the implementation of direct broadcast satellite systems, and because a change in the ex parte status of these applications would facilitate a transparent resolution of these issues, we hereby modify the status for processing these applications. Both applications shall be treated on a non- restricted, permit- but- disclose basis. 47 C. F. R. §§ 1.1200( a), 1.1206 and 1.1208, Note 2. This action is taken pursuant to authority found in Section 4( i) and 303 of the Communications Act of 1934, as amended, 47 U. S. Special Temporary Authority EchoStar Satellite Corporation DBS8808 SAT- STA- 20030617- 00117 P On June 17, 2003, EchoStar Satellite Corporation filed an application for renewal of Special Temporary Authority to operate a direct broadcast satellite over the two unassigned channels, 23 and 24, at the 61.5º W. L. orbit location for a period of 180 days, subject to the same conditions that apply under its current authorization. Special Temporary Authority R/ L DBS Company, LLC DBS8701 SAT- STA- 20030623- 00122 P On June 23, 2003, R/ L DBS Company, LLC filed an application for Special Temporary Authority to use the two unassigned direct broadcast satellite channels at 23 and 24 at the 61.5º W. L. orbit location. R/ L DBS also requests expedited processing in order to allow it to perform in- orbit testing on its assigned 11 channels and on the two unassigned channels at the 61.5º W.
