LOCKHEED MARTIN CORPORATION S2372 SAT- AMD- 20040130- 00009 E Amendment 01/ 30/ 2004 11: 45: 04: 27600 Date Filed: Lockheed Martin Corporation (Lockheed Martin) has filed an application to amend its application for authority to launch and operate a geostationary satellite as part of its Regional Positioning System (RPS), a global radio- navigation satellite service (RNSS) network. (See File Nos. SAT- LOA- 19990427- 00047 and SAT- AMD- 20030730- 00151). Specifically, Lockheed Martin seeks to modify the requested orbital location from 125º W. L. to 133º W. L., and to reduce the frequency spectrum requirements for both dedicated RNSS services and for telemetry, tracking, and control (TT& C) functions. Lockheed Martin seeks authority to launch and operate an RNSS payload that will be co- located with a C- band fixed- satellite service (FSS) payload for which PanAmSat Corporation (PanAmSat) is separately seeking Commission launch and operating authorization. SAT- LOA- 19991207- 00119, SAT- AMD- 20021029- 00199, SAT- AMD- 20030818- 00156, and SAT- AMD- 20031103- 00320). In its amendment, Lockheed Martin requests a waiver of Section 25.116( b)( 1). Under Section 25.116( b)( 1) of the Commission’s Rules, 47 C. F. R. § 25.116( b)( 1), a change in orbital location or frequency bands pursued via an amendment is deemed to be a "major amendment" unless one of the circumstances listed in Section25.116( c), 47 C. F. R. § 25.116( c), applies. To the extent that Lockheed Martin’s RPS application is not "NGSO- like" for purposes of the Commission’s Rules, or that the Commission determines that the exceptions to Section 25.116( b) are not available, Lockheed Martin requests contingently a waiver of Section 25.116( b)( 1). In addition, Lockheed Martin seeks a one- week waiver of the "substantially complete" requirement, which will allow it to supplement this Amendment next week with the full technical parameters for this payload. Lockheed Martin asserts this waiver is de minimis and will facilitate the satisfaction of Lockheed Martin’s and the U. S. Government’s obligations under Resolution 609. Finally, Lockheed Martin also respectfully requests that the Commission waive its recently adopted requirement that satellite licensees post a $5 million performance bond within thirty days of a license grant. This Amendment contains a full set of technical and regulatory showings, and is to be considered in conjunction with the portions of the RPS Application, as amended in July 2003, that are not specifically replaced in this Amendment. Lockheed Martin has requested a waiver of the "major amendment" provision in Section 25.116( b)( 1), in order to permit the relocation of the RPS satellite originally slotted for 129º W. L. to 133º W. L. and the alignment of its TT& C spectrum requests with those made by PanAmSat. In addition, Lockheed Martin seeks a waiver the recently adopted requirement that satellite licensees post a $5 million performance bond within thirty days of a license grant. See 47 C. F. R. § 25.149.
