Celsat America, Inc. S2139 SAT- MOD- 20040717- 00134 E Modification 07/ 17/ 2004 20: 07: 34: 22000 Date Filed: Celsat America, Inc. (Celsat), has filed an application to modify its authorization to contruct a two- satellite mobile satellite system (MSS) in the geostationary satellite orbit at the 83 degree W. L. and 121 degree W. L. orbital locations. Celsat is licensed to use service links in the 2 GHz MSS band (DA 01- 1632) and the feeder links in the Ka- band (DA 01- 1682). Specifically, Celsat seeks authority to: 1) relinquish its authorization to use Ka- band and S- band frequencies at the 83º W. L. orbital location; 2) waive and/ or extend its milestone to launch its 2 GHz spacecraft to February 16, 2007 from June 25, 2005; and 3) make certain techical changes to its satellite design. Celsat also proposes a new interium milestone, to complete revised critical design review, of January 17, 2005. In addition, due to modifications in the Celsat system under construction, Celsat also requests a waiver of the first (execution of non- contingent contract), second (complete critical design review) and third (commencement of construction) milestones to extent necessary to ensure compliance with its license. (DigitalGlobe) has filed an application to modify its Non- Geostationary Satellite Orbit (NGSO) license in the Earth Exploration Satellite Service (EESS). Specifically, DigitalGlobe seeks authority to construct, launch, and operate three remote sensing NGSO satellites and two on- ground spare satellites to operate in the EESS allocation within the 8025 - 8400 MHz band (X- band). In addition, DigitalGlobe seeks authority to expand the bandwidth currently used by its Quickbird 1 satellite in order to operate in the entire spectrum band allocated for EESS space- to- earth transmissions, i. e., 8025 to 8400 MHz. DigitalGlobe also requests a waiver of Sections 25.156 and 25.157 of the Commission’s rules, which requires the Commission to process DigitalGlobe’s application in accordance with the processing round procedure used generally for NGSO satellite systems. Instead, DigitalGlobe asks us to process its application under the first- come first- served procedure used for satellites operating in geostationary- satellite- like orbits. This Public Notice is without prejudice to Commission action on Space Imaging LLC's Petition for Clarification filed September 12, 2004 (See In the Matter of Amendment of the Commission's Space Station Licensing Rules and Policies, IB Docket No. 02- 34).
