S2371 SAT- AMD- 20040130- 00008 E Amendment 01/ 30/ 2004 11: 42: 28: 50600 Date Filed: Lockheed Martin Corporation Lockheed Martin Corporation (Lockheed Martin) has filed an application to amend its application for authority to launch and operate a geostationary satellite as part of its Regional Positioning System (RPS), a global radio- navigation satellite service (RNSS) network. (See File Nos. SAT- LOA- 19990427- 00046, SAT- AMD- 20030730- 00150, SAT- AMD- 20040130- 00008.) Specifically, Lockheed Martin seeks to modify the requested orbital location from 109° W. L. to 107.3° W. L., and to reduce the frequency spectrum requirements for both the dedicated RNSS services and for telemetry, tracking and control (TT& C) functions. Lockheed Martin seeks authority to launch and operate an RNSS payload that will be co- located with a C- and Ku- band fixed- satellite service (FSS) payload aboard Telesat Canada's (Telesat) Anik F1R satellite. Lockheed states that Telesat holds an authorization from the Canadian government, for the Anik F1R satellite at the 107.3° W. L. orbital location. In its amendment, Lockheed Martin requests a waiver of Section 25.116( b)( 1). Under Section 25.116( b)( 1) of the Commission's Rules, 47 C. F. R. § 25.116( b)( 1), a change in orbital location or frequency bands pursued via an amendment is deemed to be a "major amendment" unless one of the circumstances listed in Section 25.116( c), applies. To the extent that Lockheed Martin's RPS application is not "NGSO- like" for purposes of the Commission's Rules, or that the Commission determines that the exceptions to Section 25.116( b) are not available, Lockheed Martin requests contingently a waiver of Section 25.116( b)( 1). In addition Lockheed Martin seeks a one- week waiver of the "substantially complete" requirement, which will allow it to supplement this Amendment next week with the full technical parameters for this payload. Lockheed Martin asserts this waiver is de minimis and will facilitate the satisfaction of Lockheed Martin's and the U. S. Government's obligations under ITU Resolution 609. Finally, Lockheed Martin also respectfully requests that the Commission waive its requirement that satellite licenses post a $5 million performance bond within thirty days of a license grant. This Amendment contains a full set of technical and regulatory showings, and is to be considered in conjunction with the portion of the RPS Application, as amended in July 2003 (See File Nos. SAT- LOA- 19990427- 00046, SAT- AMD- 20030730- 00150), that are not specifically replaced in this Amendment. Lockheed Martin has requested a waiver of the "major amendment" provision in Section 25.116( b)( 1), in order to (i) permit the relocation of the RPS satellite originally slotted for 109 W. L. to 107.3 W. L., (ii) the alignment of its TT& C requests with the authorization granted to Telesat, and (iii) a slight adjustment of the C- band uplink frequencies due to requirements imposed by the manufacturer of the RNSS payload to be included on the Anik F1R satellite. S. operations in the 19.7- 20.2 GHz and 29.5- 30.0 GHz frequency bands can be removed and no similar condition be imposed on operations in the other portion of the band.
