C. – The Federal Communications Commission today released a Memorandum Opinion and Order affirming the $25,000 forfeiture it imposed on A- O Broadcasting, Inc. (“ A-O”), licensee of former FM Station KTMN, Cloudcroft, New Mexico, for violating radiofrequency radiation (“ RFR”) exposure limits applicable to tower transmitters, and for failing to install and operate Emergency Alert System (“ EAS”) equipment. The action denies A- O’s petition for reconsideration of the Commission’s December 29, 2003 Forfeiture Order. The 2003 Forfeiture Order was the first time the FCC imposed a monetary forfeiture for violation of its RFR exposure limits.
