This is a Notice of Violation (" Notice") issued pursuant to Section 1.89 of the Commission’s Rules, 1 to JTech Communications Inc. (“ JTech”), licensee of radio station WPPU963. 2. On November 9, 2004, an agent of the Commission’s Columbia Office inspected a radio station located at Best Buy Store #263, 9031 Snowden Square Drive, Columbia, Maryland. A Best Buy representative stated that the station was licensed to JTech Communications and provided a contact. 3. On November 17, 2004, the Columbia Office issued a letter of inquiry to JTech to determine under what authority the station was being operated. JTech responded by letter received December 7, 2004, stating that they operated the Columbia, Maryland Station under FCC license WPPU963. The agent reviewed the authorization and found the following violations: 47 C. F. R. §1.903( a): “Stations in the Wireless Radio Services must be used and operated only in accordance with the rules applicable to their particular service as set forth in this title and with a valid authorization granted by the Commission under the provisions of this part.” At the time of the inspection, the agent observed the station using a 20KF2D emission which is not authorized. The agent also determined that JTech operates more than one transmitter. The station license authorizes only one unit nationwide. 4. Pursuant to Section 308( b) of the Communications Act of 1934, as amended, 2 and Section 1.89 of the Commission's Rules, JTech must submit a written statement concerning this matter within twenty (20) days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific action( s) taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action( s).
