On March 17, 2005, the Commission released a Second Order on Reconsideration and Further Notice of Proposed Rulemaking, FCC 05- 75 in the above captioned proceeding. This Erratum corrects Paragraph 42 to read: 42. The Second Order on Reconsideration portion of this Second Order on Reconsideration and Further Notice of Proposed Rulemaking has been analyzed with respect to the Paperwork Reduction Act of 1995 (“ PRA”). 152 This document contains new information collection requirements subject to the Paperwork Reduction Act of 1995 (PRA), Public Law 104- 13. It will be submitted to the Office of Management and Budget (OMB) for review under Section 3507( d) of the PRA. OMB, the general public, and other Federal agencies are invited to comment on the new information collection requirements contained in this proceeding. In addition, we note that, pursuant to the Small Business Paperwork Relief Act of 2002, Public Law 107- 198, see 44 U. S. C. 3506( c)( 4), we previously sought specific comment on how the Commission might “further reduce the information collection burden for small business concerns with fewer than 25 employees.” In this present document, we have assessed the effects of the reporting requirements imposed herein, and find that there is unlikely to be an increased administrative burden on businesses with fewer than 25 employees. Although we believe that many LPFM permittees and licensees are small business concerns with fewer than 25 employees, we do not believe that the requirements imposed in this Second Order on Reconsideration will create an administrative burden. The Second Order on Reconsideration amends the definitions of minor change and minor amendment in order to increase flexibility in transmitter site relocation for LPFM authorizations. This may result in an increased number of minor change applications and minor amendments being filed. However, because we adopted this rule to relax restrictions on LPFM applicants, permittees, and licensees, we believe the requirement will favorably impact these entities. 2. Add paragraphs 43 to 47 and footnotes 153 – 154 to read: 43. This Further Notice of Proposed Rulemaking has been analyzed with respect to the PRA and contains proposed information collection requirements. The Commission, as part of its continuing effort to reduce paperwork burdens, invites the general public and the Office of Management and Budget (OMB) to comment on the proposed information collection requirements contained in this Notice, as required by the PRA. 152 The Paperwork Reduction Act of 1995 (“ PRA”), Pub. Comments should address: (a) whether the proposed collection of information is necessary for the proper performance of the functions of the Commission, including whether the information shall have practical utility; (b) the accuracy of the Commission’s burden estimates; (c) ways to enhance the quality, utility, and clarity of the information collected; and (d) ways to minimize the burden of the collection of information on the respondents, including the use of automated collection techniques or other forms of information technology. In addition, pursuant to the Small Business Paperwork Relief Act of 2002, 153 we seek specific comment on how we might “further reduce the information collection burden for small business concerns with fewer than 25 employees.” 45.
