On March 16, 2005, the Commission released a Report and Order, FCC 05- 70, in the above-captioned proceeding. This Erratum corrects the following: 2. In Section IV. H. 2, add new paragraphs 169, 170, and 171 to read as follows (existing paragraphs 169- 182 are renumbered as 172- 185): 169. With the assistance of the Part 2 editor of the Code of Federal Regulations (C. F. R.), we make several non- substantive formatting modifications that are designed to improve the readability of the Table. For example, we are revising the Table margins in order to provide for the largest possible display in 47 C. F. R. § 2.106; increasing the spacing between footnotes; and increasing the width of the indention for allocated services that span more than one line. These formatting changes reduce the amount of white space in the Table, which in turn reduces the number of Table pages from 67 to 65. The revised Table can be obtained by downloading the FCC Online Table of Frequency Allocations at http:// www. fcc. gov/ oet/ spectrum/. 170. With the assistance of NTIA, we are making various editorial amendments to the International Table, the Federal Table, the non- Federal Table, and the FCC Rule Part cross references. In the International Table, we are removing two incorrect footnote references (footnote 5.56 from the band 70- 72 MHz in the Region 1 Table and footnote 5.425 from the band 5470- 5570 MHz). In the Federal and non- Federal Tables, we are removing reference to footnote US10 (Civil Air Patrol frequencies) from the band 26480- 26950 kHz because this footnote was previously deleted in the Above 28 MHz Report and Order. 171. In the non- Federal Table, we are adding a reference to footnote NG142 (portion of the TV vertical blanking interval may be used for telecommunications) in all of the TV bands and to footnote NG115 (wireless microphones may be authorized) in the band 76- 88 MHz. Because footnote NG159 applies to more than one allocated service (it applies to the fixed, mobile, and broadcasting services), we are also moving the reference to footnote NG159 from the right of the broadcasting service to the bottom of the cell representing the band 698- 764 MHz. In the FCC Rule Part cross reference column, we are 1 Federal Communications Commission DA 05- 2010 2 adding “Radio Broadcast (HF)( 73)” to the band 7100- 7300 kHz; merging the bands 137- 137.175 MHz and 137.175- 138 MHz in column 6 so that “Satellite Communications (25)” applies to the band 137- 138 MHz; and removing “Fixed Microwave (101)” from the band 4940- 4990 MHz (which has been designated for Public Safety use). Finally, with regard to footnote US389, we are implementing a recommendation from the Office of Insular Affairs that the insular areas be referred to in the same manner as States, i. e., that we use “Guam” not the “Territory of Guam” in our Rules. 3. Revise the final rules in Appendix A: (a) Add in amendatory instruction 9. a: “The first page of the Table of Frequency Allocations shall be on a left- hand page.” (b) Revise 47 C. F. R. § 2.106, the Table of Frequency Allocations, as follows: (1) In the International Table: (i) In the band 70- 72 kHz, remove the reference to footnote 5.56 from the Region 1 Table. (ii) In the band 5470- 5570 MHz, remove the reference to footnote 5.425.. (2) In the United States Table: (i) In the Federal and non- Federal Tables, remove the reference to footnote US10 from the band 26480- 26950 kHz. (ii) In the Federal Table, correct the spelling of “MARITIME RADIONAVIGATION” in the band 5600- 5650 MHz. (iii) In the non- Federal Table: (A) In the bands 54- 72 MHz, 76- 88 MHz, 174- 216 MHz, 470- 608 MHz, and 614- 806 MHz, add the reference to footnote NG142. (B) In the band 76- 88 MHz, add the reference to footnote NG115. (C) In the band 698- 764 MHz, move the reference to footnote NG159 from the right of the broadcasting service to the bottom of the cell. (D) The band 7190- 7250 MHz is subdivided into the bands 7190- 7235 MHz and 7235- 7250 MHz. (E) Merge bands 8025- 8215 MHz and 8215- 8400 MHz to form the band 8025- 8400 MHz. (3) In the FCC Rule Part( s) column: (i) In the band 7100- 7300 kHz, add “Radio Broadcast (HF)( 73)”.. (ii) Merge bands 137- 137.175 MHz and 137.175- 138 MHz to form the band 137- 138 MHz so that “Satellite Communications (25)” is listed only once. (iii) Remove in the band 4940- 4990 MHz, “Fixed Microwave (101)”. (4) In the list of United States footnotes: (i) Remove the section symbol in footnotes US210, US321, US340, US350, US362, and US396.. (ii) In footnote US389, replace “Finegayan (Territory of Guam)” with “Finegayan (Guam).” (c) Revise the note to paragraph (f)( 2) in Section 73.702 to read as follows: NOTE TO (f)( 2): For the allocation of frequencies, the ITU has divided the world into three Regions, which are defined in 47 CFR 2.104( b).
