ITC- MOD- 20050802- 00430 P Mobile Satellite Ventures Subsidiary LLC (MSV), requests, pursuant to Section 63.13 of the rules, that the Commission reclassify MSV as a non- dominant international carrier on the U. S.- Canada route. In November 2001, MSV was classified as dominant on the U. S.- Canada route because it was more than 25 percent owned by TMI Communications and Company, LP (TMI), which in turn was directly owned by BCE, Inc. (BCE), which owns or is affiliated with foreign carriers presumed to have market power in Canada. See Motient Services Inc. and TMI Communications and Company, LP, Assignors, and Mobile Satellite Ventures Subsidiary LLC, Assignee, File Nos. SAT- ASG- 20010302- 00017 et al. 16 FCC Rcd 20469, 20479- 80, paras. 27- 30 (2001). According to the MSV filing TMI's interest, and thus the indirect interest of BCE, in MSV has fallen below 25 percent and thus BCE is no longer affiliated with MSV under the Commission's rules. See 47 C. F. R. 63.09( e). Specifically, TMI's direct interest and BCE's indirect interest in MSV is now approximately 21.8 percent.
