On November 17, 2004, the International Bureau released the Foreign Ownership Guidelines for FCC Common Carrier and Aeronautical Radio Licenses, DA 04- 3610. 1 This Erratum corrects the last sentence of the first full paragraph on page 18 and the last footnote of that paragraph to read as follows: A different standard applies in the context of broadcast licenses and applicants. The Commission has stated that, while a broadcast licensee has flexibility in the manner in which it chooses to demonstrate insulation, a foreign limited partner will be deemed to be effectively insulated for purposes of calculating the Section 310( b) foreign ownership benchmarks if the licensee can demonstrate that the foreign limited partner conforms to the specific insulation criteria for exemption from attribution under the media ownership rules. 43 Specifically, the Commission applies the multiplier in calculating foreign voting interests held in a broadcast licensee through an intervening domestically organized limited partnership if the licensee can demonstrate that the foreign limited partner satisfies the specific insulation criteria for exemption from attribution under the media ownership rules and is therefore effectively insulated from active involvement in partnership affairs. 44 ---------------------- 43 See Wilner & Scheiner I, 103 F.
