On May 1, 2007, the Satellite Division granted the request of RaySat, Inc. ("RaySat") to designate RaySat's earth station
application to operate 4,000 in-motion mobile satellite antennas in the 14.0-14.5 GHz and 11.7-12.2 GHz frequency bands as
"permit-but-disclose" for purposes of the Commission's rules governing ex parte communications.  See Letter from Carlos M.
Nalda, Counsel to RaySat, Inc., to Marlene H. Dortch, Secretary, FCC, dated Apr. 25, 2007.  We find that designating RaySat's
application as "permit-but-disclose" will facilitate resolution of the complex technical and policy issues raised by the application
that are also the subject of a pending rulemaking proceeding.  See Amendment of Parts 2 and 25 of the Commission's Rules to
Allocate Spectrum in the Ku- and Extended Ku-Bands to the Vehicle Mounted Earth Station Satellite Service (VMES) on a Shared
Primary Basis and to Adopt Licensing and Service Rules for VMES Operations in the Ku- and Extended Ku-Bands, Petition for
Rulemaking, RM No. 11336 (filed May 24, 2006).  Thus, we designate  File No. SES-LIC-20060629-01083 as
"permit-but-disclose," effective May 1, 2007.  See 47 C.F.R. §§ 1.1200(a), 1.1206 and 1.1208 note 2.  This action is without
prejudice to any determination regarding the processing of the application.
