Washington, D.C. 20554 August 2007 WHAT YOU OWE – COMMERCIAL WIRELESS SERVICES FOR FY 2007 This Fact Sheet pertains to holders of licenses in the following commercial wireless services: Commercial Mobile Radio Service (CMRS), Broadband Radio Service (BRS) (formerly known as multipoint distribution service (MDS) and multichannel multipoint distribution service (MMDS)), and local multipoint distribution service (LMDS). CMRS licensees include: specialized mobile radio services (Part 90); public coast stations (Part 80); public mobile radio, cellular, 800 MHz air-ground radiotelephone, and offshore radio services (Part 22); and PCS broadband services (Part 24). The CMRS messaging services category includes all one-way (Parts 22 and 90), two-way paging, qualifying interconnected business radio services, 220- 222 MHz land mobile systems (Part 90), PCS narrowband services (Part 24) (e.g. one-way and two- way paging), and all SMR systems authorized for operation with less than 10 MHz bandwidth (Part 90). All other private wireless regulatory fees that are not noted here are paid in advance for the full license term and are submitted along with the appropriate application fee. CMRS PROVIDERS Who Must Pay: CMRS cellular providers, CMRS mobile service licensees, and CMRS messaging licensees. The CMRS messaging category includes all one-way (Parts 22 and 90), two- way paging, qualifying interconnected business radio services, 220-222 MHz land mobile systems (Part 90), PCS narrowband services (e.g. one-way and two-way paging), and all SMR systems authorized for operation with less than 10 MHz bandwidth. CMRS providers owe regulatory fees for each license held as of October 1, 2006, even if a license expired after October 1, 2006. In instances where a license or authorization is transferred or assigned after October 1, 2006, the fee must be paid by the party that is the licensee or holder of the authorization on the date that the fee payment is due. Payment and Documentation Requirement: CMRS fees are assessed on the number of telephone numbers or unit counts, as stated in the table below. If you received a letter from the FCC regarding your CMRS cellular or mobile telephone number count, you should use the telephone number count identified on the second or final letter. All other CMRS cellular and mobile licensees who did not receive a letter from the FCC should use the number of telephone numbers or units as of December 31, 2006. CMRS Messaging (Paging) licensees were not sent a letter from the FCC, and should therefore use the number of telephone numbers or units as of December 31, 2006 for their subscriber count. 2 Pursuant to 47 CFR Section 1.1157(d), CMRS providers must retain for a period of two (2) years from the date on which their regulatory fee is paid, those business records that were used to calculate their fee payment. Type of Fee Regulatory Fee Payment Payment Type Code CMRS Cellular Radio (Part 22) and CMRS Mobile Services (Parts 22, 24, 27, 80 and 90) Beginning this year, all Cellular Radio and Mobile Services are to use the same Payment Type Code 0711. No one should use Payment Type Code 0712. $0.18 per telephone number/unit 0711 CMRS Messaging Services (Parts 22, 24 and 90) $0.08 per unit 0713 BRS (FORMERLY MDS AND MMDS) AND LMDS PROVIDERS Who Must Pay: BRS and LMDS providers owe regulatory fees for each license held as of October 1, 2006, even if a license expired after October 1, 2006. In instances where a license or authorization is transferred or assigned after October 1, 2006, the fee must be paid by the party that is the licensee or holder of the authorization on the date that the fee payment is due. Fee Requirement: Regulatory fees for BRS are assessed on a per license basis, whereas regulatory fees for LMDS are assessed on a per call sign basis as follows: Type of License Regulatory Fee Payment Type Code BRS (Formerly MDS/MMDS) $325 0714 LMDS $325 0785 LIMITATIONS ON CREDIT CARD TRANSACTIONS The U.S. Treasury will reject Credit Card transactions greater than $99,999.99 from a single credit card in a single day, in accordance with U.S. Treasury Bulletin No. 2005-03. If you need to pay $100,000.00 or more, then you must pay via a check, debit, or wire transfer. 3 USE FEE FILER We strongly encourage you to submit your FY 2007 regulatory fee payment via Fee Filer. The benefits of electronically filing and paying via Fee Filer are expeditious payment submissions that are less expensive (no U.S. postage if paying online) and less prone to error. It also results in improved record keeping and payment reconciliation efforts, and reduces paperwork burdens on payers and Commission staff alike. Traditionally, regulatees needing to make voluminous payment transactions have had to use hardcopy Form 159-Cs (Continuation Sheets). These payers will benefit even more so by using Fee Filer. Having expanded our pre-billing initiatives in FY 2007, some regulatees may receive more than one Form 159-B; and some may be obligated to pay for fees that were pre-billed and other fees that were not pre-billed. Fee Filer relieves regulatees of the need to follow different filing instructions for different fees; and enables all fee obligations to be paid simply either online or by following pre-printed instructions on a Fee Filer-produced voucher. Fee Filer accepts electronic credit card transactions of up to $99,999.99 and ACH payment transactions from a bank account of an unlimited dollar amount. Fee Filer also facilitates payment by check or wire transfer by producing a one-page Remittance Voucher Form 159-E which can be mailed to our lockbox bank. Fee Filer can be accessed at http://www.fcc.gov/fees/feefiler.html. Instructions for Completing FCC Forms 159 & 159-C We strongly encourage you to submit your regulatory fee payment via Fee Filer. However, if you choose to submit payment with a completed hardcopy Form 159, the following filing instructions apply to CMRS, BRS and LMDS licensees. Block (9) - Telephone Number: Ø Please enter the contact name and telephone number of the specific individual responsible for submitting the payment and supporting Form 159 and FCC Form 159-C. Block (11) - PAYER FRN: Ø Enter the fee payer's FRN number. Block (21) - APPLICANT FRN: Ø If different from payer, enter the applicant's FRN number. Block (23A) - FCC CALL SIGN/OTHER ID: Ø This block should be left blank. All CMRS providers may report aggregate subscriber totals without having to identify corresponding call sign. Block (24A) - PAYMENT TYPE CODES: Ø Enter 0711 for a fee payment for a CMRS cellular radio license and a mobile radio license ($0.18 per telephone number/unit). Ø Enter 0713 for a fee payment for a CMRS messaging license ($0.08 per unit). Ø Enter 0714 for a fee payment for a BRS license ($325 per license). 4 Ø Enter 0785 for a fee payment for a LMDS license ($325 per call sign). Block (25A) - QUANTITY: Ø CMRS cellular radio licensees should enter the number of telephone numbers/units. Ø CMRS mobile radio licensees should enter the number of telephone number/units. Ø CMRS messaging licensees should enter the total number of units. Block (27A) - TOTAL FEE: Ø For CMRS cellular radio and mobile radio licensees (payment type code 0711), multiply the amount in Block 25A (Quantity) by $0.18. Enter exact dollars and cents; do not round. Ø For CMRS messaging licensees (Payment Type Code 0713), multiply the amount in Block 25A (Quantity) by $0.08. Enter exact dollars and cents; do not round. Ø For BRS (formerly MDS/MMDS) licensees (Payment Type Code 0714), multiply the amount in Block 25A (Quantity) by $325.
