INTRODUCTION AND BACKGROUND 1. The Media Bureau presents this DTV Transition Home Stretch Report to describe the status of the digital build out by full power television broadcasters. The numbers presented in this Report are derived from the information provided by stations in their FCC Form 387 DTV Transition Status Report1 and other filings. Our goal in this Report, six months prior to the transition deadline, is to provide the Commission with a status of the overall readiness of the 1,798 active full power television stations to complete the DTV transition by February 17, 2009.2 Approximately 56 percent of television stations (1002) have completed construction of their posttransition DTV facilities and are fully operational and already ready for the transition. 41 percent of stations (736) have not completed construction yet but report making appropriate progress and expect to be operating their full digital service by February 17. Approximately 3 percent (56 stations) will take advantage of the flexibility offered by the Commission in the Third DTV Periodic Review Report and Order 3 and will be serving at least 85 percent of their service population on February 17, 2009, with final operations beginning sometime thereafter.One station, a satellite of another station, forecasts that it will not be able to complete construction of its digital facility until a few days after February 17, 2009 and will be dark for this brief time. Finally, 3 stations have not submitted their Form 387s and have not officially reported when they will be ready for DTV transition, but each station has represented to video division staff orally that it is on track to complete digital construction by February 17th. 2. In this Report we first provide the background regarding Form 387 and briefly summarize our findings. Next we describe each category of stations in detail: (A) those that have completed the construction of their full, authorized post-transition facility; (B) those that have not completed construction but are on track to do so; and (C) those that are reporting they will need to take advantage of the flexibility offered by the Commission in the Third DTV Periodic Review Report and Order to serve 85 percent or more of their viewers on February 17, 2009, and complete construction of their full digital facility thereafter. In Section D, we describe three stations that have not filed Form 387, but have reported informally that they plan to flash-cut by February 17, 2009. Section E describes those stations that report they are planning to reduce or turn off their analog service early. 1 See Attachment 1. Initially the total number of full power television stations was 1,817, however, 4 stations have unbuilt single-channel construction permits that have expired and are no longer valid; 1 station's license was cancelled by the licensee; and 1 station's license expired license (no renewal application was filed). Thus, the current number of full power television stations is 1,811. In addition, for purposes of this Progress Report, thirteen stations are neither expected nor required to be broadcasting by February 17, 2009. These include ten stations that are new permittees that have construction deadlines after February 17, 2009; and three stations that are new stations that do not have a DTV construction deadline because they have not yet been assigned a channel in the post-transition DTV Table of Allotments. This Progress Report, therefore, focuses on 1,798 stations that are expected to provide digital service on and after February 18, 2009. 3 Third Periodic Review of the Commission’s Rules and Policies Affecting the Conversion to Digital Television, MB Docket No. 07-91, Report and Order, 23 FCC Rcd 2994 (2007) (Third DTV Periodic Review Report and Order). 4 3. Background. Congress has mandated that after February 17, 2009, full-power television broadcast stations must terminate analog operations and transmit in digital only.4 In the Third DTV Periodic Review Report and Order, the Commission resolved the final issues remaining to assist in the completion of the conversion of the nation’s broadcast television system from analog to digital.5 Specifically, the Commission adopted rules to ensure that broadcasters meet their statutory responsibilities and begin operations by their final, post-transition DTV channels upon expiration by February 18, 2009.6 4. As part of our effort to ensure that broadcasters are taking the steps necessary to complete their final, post-transition DTV facilities and to identify areas where the Commission could assist to eliminate or reduce potential roadblocks to construction, the Commission adopted FCC Form 387 and required all full-power television stations to file it by February 18, 2008.7 In FCC Form 387, broadcasters were required to detail their current transition status, any additional steps necessary for digital-only operation by February 17, 2009, and a timeline for making those steps. The Commission required stations to update the form as events warrant and by October 20, 2008, if they have not completed construction by that date.8 5. The Commission also stated that the Media Bureau would prepare a comprehensive summary report of the information provided in the Form 387 by August 18, 2008 (six months prior to the February 17, 2009 transition deadline).9 The Commission stated that the report would enable the Commission “to assess progress toward completing the transition and to make any mid-transition adjustments in time for the February 17, 2009 deadline.”10 4 See Digital Television and Public Safety Act of 2005 (“DTV Act”), which is Title III of the Deficit Reduction Act of 2005, Pub. L. No. 109-171, 120 Stat. 4 (2006) (“DRA”) (codified at 47 U.S.C. §§ 309(j)(14) and 337(e)). DTV Act § 3002(a) amends Section 309(j)(14) of the Communications Act of 1934 to establish February 17, 2009 as a new hard deadline for the end of analog transmissions by full-power stations. 47 U.S.C. § 309(j)(14)(A). DTV Act § 3002(b) directs the Commission to “take such actions as are necessary (1) to terminate all licenses for full-power television stations in the analog television service, and to require the cessation of broadcasting by full-power stations in the analog television service, by February 18, 2009; and (2) to require by February 18, 2009, … all broadcasting by full-power stations in the digital television service, occur only on channels between channels 2 and 36, inclusive, or 38 and 51, inclusive (between frequencies 54 and 698 megahertz, inclusive).” 47 U.S.C.A. § 309 Note. 5 Third DTV Periodic Review Report and Order at ¶2.. 6 Id. 7 See Third DTV Periodic Review Report and Order at ¶¶34-35. Quick statistics. In summary, the reports reflect that 1,002 of a total of 1,798 active television stations have completed their post-transition digital facilities and are ready for the digital transition. Of the remaining 796 stations that have not completed their final DTV facilities, 736 stations (over 91 percent) report that they are on track to complete construction by their August 18, 2008, November 19, 2008 or February 17, 2009 construction deadlines.11 This includes 642 stations that will be moving to another DTV channel for post-transition operation and 69 stations that were identified as facing a “unique technical challenge.”12 Fifty-six stations will take advantage of the flexibility offered by the Commission in the Third DTV Periodic Review Report and Order and will be serving at least 85 percent of their service population on February 17, 2009, with final operations beginning sometime thereafter. One station, a satellite of another station, forecasts that it will not be able to complete construction of its digital facility until a few days after February 17, 2009 and will be dark for this brief time. Finally, 3 stations did not submit their Form 387s and have not officially reported when they will be ready for DTV transition, but each station has represented to video division staff orally that it is on track to complete digital construction by February 17th. As outlined below, the Commission staff is aware of the issues and challenges facing each of these stations, and is working directly with these remaining stations to provide support. SUMMARY 1,798 Total Active Television Stations 1,002 Stations with Fully-Operational Post-Transition DTV Facilities 736 Stations On-Track to Complete Construction Before February 17, 2009 56 Stations Report Expecting to Serve at Least 85 percent of their Digital Population With Full Construction Completed After February 17, 2009 1 Station Will Go Dark for 3-4 Days and Will Begin Full Digital Operations by Approximately February 21, 2009 3 Stations That Did Not File Form 387 11 In the Third DTV Periodic Review Report and Order, the Commission established August 18, 2008 as the construction deadline for stations that will use their pre-transition DTV channel for post-transition operations, but which do not have a construction permit that matches their post-transition (DTV Table Appendix B) facilities. See Third DTV Periodic Review Report and Order at ¶49. The Commission designated 36 stations in Appendix F of the Third DTV Periodic Review Report and Order with an August 18, 2008 deadline. The Commission also established May 18, 2008 as the construction deadline for stations that will use their pre-transition DTV channel for post-transition operations and already have a construction permit that matches their post-transition (DTV Table Appendix B) facilities. Id. at ¶48. The Commission designated 82 stations in Appendix F with a May 18, 2008 deadline. Of those 82 stations, 63 stations filed DTV extension applications that were granted by staff action on May 19, 2008, and thus these stations were given six-month extensions until November 19, 2008. 12 There were 49 stations that were originally identified by the Commission as facing a “unique technical challenge” and were given a February 17, 2009 construction deadline. Unique technical challenges included side-mounted and top-mounted antennas that must be switched or replaced. In addition, 20 stations made the requisite showing in their Form 387s or elsewhere and were determined to be facing a “unique technical challenge” and their construction deadline was modified to February 17, 2009. See “Television Stations Identified as Facing ‘Unique Technical Challenge’ – DTV Construction Deadline Modified to February 17, 2009,” Public Notice, DA 08-1672, July 17, 2008. 6 7. The data show that the Commission’s processes, many of which were adopted in the Third DTV Periodic Review Report and Order,13 have provided stations with the tools necessary to ensure a successful digital transition. For example, stations have been able to identify an acceptable digital channel and operating parameters due to completion of the DTV Table of Allotments proceeding last year. In addition, stations have been able to secure a digital construction permit for their post-transition DTV facilities, many within several days of filing their applications, thanks to expedited processing of such applications by the Commission’s staff. To date we have received a total of 672 applications for construction permit for post-transition facilities. We are pleased to report that, as a result of the exemplary work of the Commission’s staff,14 to date, 649 applications for post-transition DTV facilities have been processed and granted, and stations have received their DTV construction permits to expedite the completion of their DTV construction.15 8. Those stations justifiably needing additional time to construct have been able to obtain such relief under the Commission’s strict extension criteria or through the Commission’s flexible “phased transition” procedures.16 Finally, stations that need to terminate or reduce their analog or pre-transition digital service in order to make the necessary changes to their posttransition DTV facilities have been quickly granted such relief and reminded of the obligation to provide viewer notifications in advance.17 These situations are described in this Report and individual stations are identified in the Appendices. The Commission remains dedicated to providing all stations with all means at their disposal to help them to make it to the digital finish line. 13 Third DTV Periodic Review Report and Order, supra. 14 The Video Division acted on applications in an average of 4 days from the date of receipt during the expedited processing period which ended March 17, 2008. 15 The circumstances affecting the grant of the remaining 23 applications are addressed below in Sections II. See Section II-C-4. 17 Stations seeking to reduce or terminate their analog or pre-transition digital service must air viewer notifications on their analog and DTV facilities every day on-air at least four times a day including at least once in primetime for a 60-day period. See Third DTV Periodic Review Report and Order at ¶¶117 and 132. These notifications must include: (1) the station’s call sign and community of license; (2) the fact that the station will be terminating its analog operations before the transition date; (3) the date of the planned termination; (4) what viewers can do to continue to receive the station, i.e., how and when the station’s digital signal can be received, and whether viewers will need to repeat the channel scan on their DTV receivers; (5) information about the availability of digital- to-analog converter boxes in their service area; and (6) the street address, email address (if available), and phone number of the station where viewers may register comments or request information. Id. 7 II. PROGRESS REPORT A. 1,002 Stations with Completed Post-Transition DTV Facilities 9. We are pleased to report that 1,002 stations (out of a current total of 1,798 active television stations) reported in their Form 387s that they have fully constructed their posttransition DTV facilities and, thus, are already ready for the DTV transition.18 The only step remaining for these stations is for each to terminate its analog operations before February 18, 2009. 19 10. In addition, eight of these stations have requested authority to complete an “early transition” by turning off their analog signal and begin operations on their post-transition channel prior to February 17. The early transition requests are currently being evaluated to determine whether early operation on post-transition DTV channels, which for these stations will be on channels different from their pre-transition DTV channel, will comply with the Commission’s interference limits between now and February 17, 2009. 11. In the Third DTV Periodic Review Report and Order, the Commission adopted “early transition” procedures to avoid a station having to complete its transition during the winter months when conditions may prevent installation of equipment.20 A station is permitted to transition early if: (1) it will not cause impermissible interference to another station; and (2) it will continue to serve its existing viewers for the remainder of the transition and commence its full, authorized post-transition operations on February 18, 2009.21 B. 736 Stations Report Being On Track To Complete Construction By February 17, 2009 12. A total of 736 stations have reported that they are making appropriate progress and will be able to complete construction of their full, post-transition DTV facilities no later than February 17, 2009.22 Of those 736 stations, 502 reported no special circumstance or impediments to their final construction. The remaining 234 stations, although not forecasting a problem meeting their final construction deadline, reported on their Form 387 certain circumstances needing their attention and the additional focus of the Commission’s staff. We describe these stations’ particular circumstances below. 1. 502 Stations Report No Impediments to Completing Construction 13. More than two-thirds of the 736 stations that are on track to complete construction no later than February 17, 2009 (502 stations) report no problems or issues with respect to their 18 See Appendix A. 19 In addition, 231 of these stations have filed applications to maximize their post-transition digital facilities. The remaining 234 stations, although not forecasting a problem meeting their final construction deadline, reported on their Form 387 certain circumstances needing their attention and the additional focus of the Commission’s staff. We summarize these stations, as follows, and describe them in more detail in the sections below: 10 Stations Requiring International Coordination with Mexico 5 Stations Requiring Fish and Wildlife Clearances 8 Stations Working With FCC To Resolve Pending Issues 24 Stations Requiring Local Land Use Approvals 35 Stations Claiming Financial Hardship 92 Stations Needing to Coordinate Construction with Other Stations 60 Stations Seeking a New Post-Transition DTV Channel 234 Total Stations Reporting Special Circumstances a. 10 Stations Require International Coordination with Mexico 15. Originally, forty-four stations reported in their initial Form 387s that they needed to obtain international clearance before their applications for post-transition DTV construction permit could be granted. Since the time those stations filed or last updated their Forms, only 10 continue to need international clearance for their post-transition DTV facilities. International Bureau and Media Bureau Staff are working closely together with the Mexican government to obtain coordination for these stations as soon as possible.24 b. 5 Stations Require Clearances from the Fish and Wildlife Service 16. Originally, fifteen stations reported on their initial Form 387s that they needed clearance from another federal agency. Specifically, ten stations reported in their initial Form 387s that they needed to obtain Federal Aviation Administration (FAA) clearance for their posttransition facility, and five stations reported needing clearance from the Fish and Wildlife Service of the Department of the Interior. All of the FAA clearances have since been obtained. Five stations have applications for post-transition DTV construction permits that remain pending because they have not yet obtained the necessary clearances from the Fish and Wildlife Service.25 Although it is the responsibility of the station to resolve this matter, if requested, the staff will provide assistance to help resolve this issue and to complete processing of their applications. 23 Id. 24 See Appendix D. 25 Id. 9 c. 8 Stations Working with FCC To Resolve Pending Issues 17. Eight stations have applications for post-transition DTV construction permits that are pending because of other Commission matters.26 One station needs approval from the Enforcement Bureau for its post-transition facility because of its proximity to a Commission monitoring station. The Media Bureau has resolved this matter with the Enforcement Bureau and a grant of this application is forthcoming. Six stations are proposing post-transition DTV facilities that would reduce their coverage and will require a public interest showing to substantiate the loss area. All six stations have been contacted and the Video Division is awaiting responses. Finally, one station is subject to a petition to deny its post-transition DTV application, which is also the subject of a pending petition for reconsideration of the Seventh Reconsideration in the DTV Table proceeding.27 The staff is working with the stations to resolve these remaining issues. d. 24 Stations Require Local Land-Use Approvals 18. A total of 24 stations reported in their Form 387s and in other filings that they would need to obtain state or local government approval (e.g., zoning) for their post-transition DTV facility.28 None of these stations has reported concern that this local approval process will prevent completion of construction by February 17, 2009. Once again, the staff is aware of these matters and will continue to assist these stations. e. 35 Stations Claim Financial Hardship 19. Thirty-five stations claimed that construction of their post-transition DTV facilities was delayed due to “financial hardship.”29 These stations sought and received extensions of construction deadlines in May or August, allowing them an additional six months to construct before February 17, 2009. In the Third DTV Periodic Review Report and Order, the Commission tightened the criteria for stations claiming financial hardship as justification for obtaining additional time to complete construction.30 Stations now must show that they are either involved in an active bankruptcy or receivership proceeding and/or have a negative cash flow for the past three years in order to obtain an extension of their construction deadline.31 Each of these thirtyfive stations was able to make the requisite showing and obtain an extension of their respective construction deadline. Each station submitted a schedule where they estimated when they would complete construction. Ninety-two stations reported in their Form 387s that they would need to coordinate their transition with other broadcast stations.32 No stations have reported in their Form 387s unreasonable delays or problems associated with these coordinations. 21. In the Third DTV Periodic Review Report and Order, the Commission found that some stations would need to coordinate their final construction efforts with other stations.33 For example, the Commission noted that some stations may be the only occupants of the tower on which the antenna is located, while other stations may share the tower with other television and radio stations and will need to coordinate tower work with these other stations. In addition, the Commission found that co-located stations may need to reduce service to allow other stations’ construction to proceed, while in other cases service may need to be halted altogether for some period of time.34 g. 60 Stations Seek a New Post-Transition DTV Channel 22. Although the DTV channel election process was completed with the release of the final DTV Table of Allotments in 2007, 60 stations have identified problems or limitations with their assigned post-transition DTV channel.35 These 60 stations seek a last-minute channel substitution. The staff has reviewed all of these requests. We must undertake a rulemaking to make the requested channel changes.36 To date, the Video Division of the Media Bureau has issued 34 Notices of Proposed Rulemaking to initiate the channel substitution process.37 Four petitions for rulemaking were dismissed as not complying with Commission rules.38 The remaining 23 petitions for rulemaking are pending action by the station that requested the channel substitution: 10 contain technical defects that the station must correct, 10 are mutually exclusive with applications filed by stations seeking to expand or “maximize” their existing digital facilities or with other rulemaking petitions; and 3 involve a loss area that must be justified by the station.39 32 See Appendix G. 33 Third DTV Periodic Review Report and Order at ¶¶98-99. 34 Id. 35 See Appendix H. 36 The Commission’s rulemaking process for television channel substitution is set forth in 47 C.F.R. § 73.623. 37 Thirty of the stations requesting channel substitution are likely to be able to remain on their pre-transition channel after the transition because it is either their current post-transition channel or it is the channel they propose to move to. 38 Two petitions were for new allotments, and were dismissed because of the freeze on such filings, and two were dismissed at the request of the petitioners. If the parties failed to resolve their mutual exclusivity within 30 days, the Bureau stated it would return both the petition for rulemaking and the maximization application. See Freeze Lift PN, supra n.23. Three petitions for rulemaking are mutually exclusive with 11 23. Channel substitutions that are not opposed and otherwise are deemed acceptable should be resolved between mid-September and mid-October 2008. Stations would then submit an application for a digital construction permit for their new channels and have the remainder of the time until February 17, 2009 to complete construction of their final DTV facilities. 24. In 2007, the Commission completed the task of assigning each station a posttransition DTV channel. In the 2004 Second DTV Periodic Review Report and Order, 40 the Commission established a three-round channel-election process through which eligible broadcast licensees and permittees (collectively, “licensees”) selected their post-transition channels inside the core TV spectrum (i.e., channels 2-51). At the start of this process, licensees proposed their post-transition facilities and after each channel election round, the Commission announced proposed post-transition channels – called tentative channel designations (“TCDs”). The channel election process culminated in the adoption of the post-transition DTV Table in August 2007.41 The post-transition DTV Table provides eligible stations channels for post-transition operations inside the core TV spectrum and is the result of informed decisions made by eligible licensees during the Commission’s channel election process, as well as the Commission’s efforts to promote overall spectrum efficiency and ensure that broadcasters provide the best possible service to the public, including service to local communities. The post-transition DTV Table, 47 C.F.R. § 73.622(i), will ultimately replace the current (pre-transition) DTV Table, 47 C.F.R. § 73.622(b), at the end of the transition. 25. In an Order released March 6, 2008, the Commission resolved Petitions for Reconsideration of the Seventh Report and Order from approximately 200 stations, many of which requested changes to their assigned channels in order to return to their current analog channel or to remain on their pre-transition digital channel.42 Despite being assigned an acceptable channel for post-transition operation, a number of stations reported in their Form 387 filing that they sought a substitution of their final, post-transition DTV channel. The reasons cited for the need to make last-minute channel substitutions included allowing stations to better maintain existing analog service, stations’ inability to expand or maximize their digital service, cost savings associated with being permitted to remain on stations’ analog or pre-transition DTV channels, and prevention of potential interference to or from other stations or government facilities. The Commission was able to lift the freeze for channel substitutions, as well as maximization applications, on June 20, 2008, ten weeks earlier than expected due to the successful processing of initial 12 C. 57 Stations Take Advantage of Flexibility Adopted in Third DTV Periodic Review 26. In the Third DTV Periodic Review Report and Order, the Commission adopted two provisions for “phased transition” in an effort to offer broadcasters regulatory flexibility in meeting their post-transition construction deadlines without disappointing viewer expectations after the transition date.44 Stations may request permission to: (1) remain on their pre-transition DTV channel for up to six months after the February 17, 2009 deadline to permit them to finalize construction, provided they serve at least 85 percent of their existing analog viewers; or (2) operate with less than full, authorized facilities on their currently constructed post-transition facility for a period of time after the transition deadline, provided they serve 100 percent of their existing analog viewers.45 In addition, the Commission adopted provisions to provide special relief for noncommercial educational (NCE) and small market stations (i.e., stations which are not a top-four network station located in television markets 1-100) whereby it will consider on a caseby- case basis allowing these stations a reduced service requirement if their circumstances warrant this additional flexibility.46 27. The Commission explained that it was adopting these provisions in response to the many comments advocating for such relief.47 The Commission noted that certain stations may not be able to provide full digital service at the February 17, 2009 transition date for a number of reasons. For example, a station may (1) face a “unique technical challenge” such a side-mounted digital antenna; (2) demonstrate that it will be unable to complete construction at the transition date because of weather delays; (3) need to coordinate its final construction with other stations and be unable to complete its construction in time. While it is critical to minimize the loss of television service after the transition date as much as possible, the Commission recognized that, in such a special situation, it may be preferable to accept a limited loss of DTV service for a limited time after the transition date to prevent a significant loss of analog service many months before the transition date.48 28. Fifty-seven stations are taking advantage of the flexibility adopted by the Commission in the Third DTV Periodic Review Report and Order.49 Fifty-six stations report that they will serve at least 85 percent or more of their viewers on February 17, 2009, and that the completion date for their full, post-transition facility will be a date after February 17, 2009. One of these 57 stations reports that it will take advantage of special flexibility for small market post-transition applications by the Commission’s staff. 44 Third DTV Periodic Review Report and Order at ¶¶88-97. 45 Id. 46 Id. at ¶97. 47 Id. at ¶95. 48 Id. 49 See Appendix I. 13 stations to go dark for 3 to 4 days after February 17, 2009, while it completes its full digital facility.50 1. 56 Stations Report They Will Serve at Least 85 Percent of Their Digital Population On February 17, 2009 With Full Digital Completion to Follow 29. Fifty-six stations report that they will serve at least 85 percent or more of their viewers on February 17, 2009, and that the completion date for their full, post-transition facility will be a date after February 17, 2009.51 These stations indicated that they will be operating a facility that serves at least 85 percent of their current viewers. Fourteen of these fifty-six stations have already requested permission to operate post-transition at slightly less than their full, authorized facility, consistent with the Commission’s “phased transition” procedures adopted in the Third DTV Periodic Review Report and Order.52 Commission staff will continue to monitor these stations and work with them to provide whatever assistance is necessary to ensure that they are able to complete full construction of their DTV facility as soon as possible after the February 17, 2009 transition deadline. 2. 1 Station Will Go Dark for 3 to 4 Days and Will Begin Full Digital Operations by Approximately February 21, 2009 30. Only one of the 57 stations reports that it will make use of the Commission’s special flexibility for small market stations because it needs to go dark for 3 to 4 days after February 17, 2009, while it completes its full digital facility. This station is KBRR, Thief River Falls, Minnesota, a Fox affiliate that is a satellite of KVRR, Fargo, ND. This station’s pretransition digital channel is 57, which is out-of-core, and its post-transition channel is 10, its current analog channel. The station reports that it will need until approximately February 21, 2009 to complete construction of its digital facility after it terminates analog service on channel 10. Staff has conferred with counsel regarding this station’s circumstances and was assured that the period without service will be a matter or 3 or 4 days. 31. Initially the station reported needing until June 1, 2009 to complete digital construction, but recently developed a plan by which it will be dark for only a matter of days rather than months. This station will, accordingly, request an extension of its DTV construction permit or seek other relief pursuant to the special relief provisions for small market stations described above.53 This station will be required to broadcast notification to its viewers prior to the transition to alert them that it will be off the air for a short time after February 17, 2009. 50 This station is KBRR, Thief River Falls, Minnesota, a satellite of KVRR, Fargo, ND and a Fox affiliate. Of the 14 phased transition requests received thus far, one has been granted. The remaining thirteen requests, in which stations ask to remain temporarily on their pre-transition DTV channel after February 17, 2009, are currently being evaluated to determine whether such operation after the transition will comply with the Commission’s interference limits. 53 See Third DTV Periodic Review Report and Order at ¶97. Although KBRR is a Fox network affiliate, it is located in the Fargo-Valley City television market that is ranked number 119. 14 D. Three Stations Did Not Submit Form 387 32. Three stations have not yet submitted their Form 387.54 All three stations are single-channel stations without a paired DTV channel. Staff has contacted each of these stations, and each indicates it is planning to flash-cut to digital operation on their existing analog channel by the February 17, 2009 transition date. These stations have also failed to submit their applications for a construction permit for their digital facility. Each has indicated to Bureau staff that they are preparing and will shortly file their Form 387s and applications for post-transition DTV operations. Each station indicates that it is taking steps to complete its flash-cut by February 17, 2009. The staff will continue to work with them. E. 198 Stations Report a Planned Reduction or Termination of Analog Operations Prior to the February 17, 2009 Transition Date 33. A total of 198 stations report on the Form 387 or other filings that they plan to reduce or terminate their analog service prior to February 17, 2009.55 106 of these stations report that they plan to reduce their analog service and 88 report that they plan to terminate their analog service prior to February 17, 2009. In addition, 4 stations that did not report their plans for early analog termination or reduction on their Form 387 have submitted and have been granted requests to reduce or terminate their analog service (3 reductions and 1 termination) pursuant to the policies and procedures adopted in the Third DTV Periodic Review Report and Order.56 Overall, we have granted permission for 18 stations to terminate their analog service early; and eight of them have already terminated. 57 In addition, 49 stations have been granted authority to reduce their analog operations58 and 28 have already undertaken the reduction.59 All stations that are approved for reductions or terminations must air Viewer Notifications in advance of the action. 54 See Appendix J. 55 See Appendix K. 56 These four stations are in addition to the 194 stations reporting plans to reduce or terminate analog service prior to February 17, 2009 on their Form 387. The station faces a unique set of circumstances that complicate the construction of its final post-transition DTV facilities. The station currently operates on two out-of-core channels that must be cleared by February 17, 2009. The antennas for WNVC’s existing analog and pre-transition DTV operations are both located on the tower upon which WNVC will install its new channel 24 digital antenna. Because of concerns with the tower’s structural integrity, WNVC must remove both the channel 56 and channel 57 antennas before hanging the new channel 24 antenna, and also remove its channel 56 and 57 transmission equipment before it can install its channel 24 transmitter, as local regulations prohibit the 15 SUMMARY OF ANALOG REDUCTIONS/TERMINATIONS Planned Analog Reduction or Termination 1,572 Stations Reporting No Plan to Reduce Analog before February 17, 2009 194 Stations Reporting Plan for Analog Reduction or Termination on Their Form 387 4 Stations Requesting Analog Reduction or Termination 28 Stations Did Not Complete the Section on Analog Reduction/Termination or Submit Form 387 Granted Analog Reductions or Terminations 49 Stations Granted Permission to Reduce Analog Service 18 Stations Granted Permission to Terminate Analog Service 34. In the Third DTV Periodic Review Report and Order, the Commission adopted streamlined procedures to allow stations to permanently reduce or terminate their analog or pretransition digital service before the transition date if necessary. Specifically, the Commission required that stations obtain prior Commission approval in order to reduce or terminate their analog or pre-transition digital service before the transition date.60 A station may reduce or terminate its analog service or pre-transition digital service before the transition date, provided the station (1) demonstrates that the service reduction or termination is directly related to the construction and operation of its, or another station’s, post-transition facilities; and (2) notifies viewers about the planned service reduction or termination and informs them about how they can continue to receive the station.61 Stations were required to set forth their analog service plans in Section V of the Form 387.62 35. The stations that have thus far filed requests to reduce or terminate their analog operations under the Commission’s Third DTV Periodic procedures have cited the need to reconfigure their analog facilities in order to prepare for final post-transition DTV operations. Many mentioned winter weather conditions or tower crew scheduling issues to justify the service further enlargement of the station’s transmitter building. To avoid the possibility of weather-related delays during the winter months, WNVC has scheduled a tower crew to begin performing the necessary tower work in late September 2008. WNVC anticipates that the work will take between six to eight weeks to complete. WNVC intends to complete construction of its final, post-transition channel 24 facilities by the end of November 2008. The station, however, cannot commence digital operations on channel 24 until station WUTB, Baltimore, Maryland, ceases its analog operations on channel 24. WUTB indicated in its Form 387 filing that it does not intend to cease analog broadcasts on channel 24 until February 17, 2009. Although WNVC will be dark during the remainder of the digital transition, the station’s programming will continue to be carried on local cable systems via fiber optic link and on the over-the-air digital channel of its sister station WNVT-DT, Goldvein, Virginia that provides digital service to over 92 percent of WNVC’s current digital viewers and reaches the home of over 82% of WNVC’s current analog viewers who can watch WNVT-DT with a digital television or converter box. 60 After November 18, 2008, stations will no longer be required to seek Commission approval but may reduce or terminate their service simply by notifying the Commission. These stations are still subject to the 30-day viewer notification requirement. All stations were reminded of the requirement to air viewer notifications 60 days prior to analog termination and 30 days prior to digital termination.63 III. CONCLUSION 36. As of August 18, 2008, six months prior to the February 17, 2009 transition, approximately 56 percent of television stations have completed construction and are ready for the transition to occur; approximately 41 percent are on track to complete construction by their respective construction deadlines. Approximately 3 percent (56 stations) have indicated that they will take advantage of the Commission’s flexible procedures and will serve at least 85 percent of their service population for a limited time after February 17, 2009, before completing construction of their full, authorized facility in a matter of months. An additional station, a satellite of another station, forecasts that it will not be able to complete construction of its digital facility until a few days after February 17, 2009 and will be dark for this brief time. These 57 stations are utilizing the procedures adopted in the Third DTV Periodic Review Report and Order to provide stations with necessary flexibility while ensuring a successful completion of the digital transition and continuing to provide service by the February 17, 2009 deadline. Finally, 3 stations have not submitted their Form 387s and have not officially reported when they will be ready for DTV transition, but each station has represented to video division staff orally that it is on track to complete digital construction by February 17th. The remaining stations that have not completed final construction will be able to make use of the Commission’s policies and rules concerning channel substitutions, expedited final licensing of their digital construction permit applications, extension of time to construct, and phased and early transition, and the reduction or termination of their analog facilities, to take the final steps necessary as they enter the home stretch of the DTV transition.
