An updated version of Section 1.767 of the rules, and other related sections, is available at http://www.fcc.gov/ib/pd/pf/telecomrules.html SCL-MOD-20080714-00012 P Application to modify the cable landing license for the Trans-Pacific Express Cable Network (TPE), SCL-LIC-20070222-00002, to add NTT Communications Corporation (NTT Com) as a licensee and to extend the TPE cable to add a landing station in Shinmaruyama, Japan. The TPE Network will directly link mainland China, South Korea, Taiwan and the United States. See File No. SCL-LIC-20070222-00002 (DA 08-66 rel. Jan. 11, 2008). NTT Com will acquire a 13.11% interest in the international waters segments of the TPE cable, and become a member of the TPE Consortium along with MCI International, Inc., China Network Communications Group Corporation, China Telecommunications Corporation, China United Telecommunications Corporation, Chunghwa Telecom Co. Ltd., KT Corporation, and AT&T Corp. The ownership in the international waters segments of the other TPE consortium members, except AT&T Corp., will be reduced from 15.09% to 13.11%. AT&T Corp. will hold a 8.20% interest. The addition of NTT Com as a licensee/owner will not affect ownership in any of the existing landing stations. NTT Com will operate the landing station in Shinmaruyama, Japan which will be added to the intra-Asian ring formed by currently operational cable landing stations in China, Taiwan and South Korea, via an additional branching unit. NTT Com, a corporation organized under the laws of Japan, is a direct, wholly-owned subsidiary of Nippon Telegraph and Telephone Corporation (NTT), a Japanese holding company. As of September 30, 2007, the Japanese Minister of Finance held 33.72% of the issued shares in NTT. No other shareholder holds 10 percent or greater equity interest in NTT. NTT Com is affiliated with carriers in three of the TPE destination markets - China, South Korea and Taiwan. NTT Com is a foreign carrier in Japan, which is a World Trade Organization (WTO) Member country, and agrees to accept and abide by the reporting requirements in section 1.767(l) of the Commission's rules, 47 C.F.R. § 1.767(l). NTT Com agrees to accept and abide by the routine conditions specified in section 1.767(g) of the Commission's rules, 47 C.F.R. § 1.767(g). MCI International, Inc. requests that grant of this modification application be conditioned on the continued compliance of Verizon Business Global LLC and its affiliates and subsidiaries, including MCI International, Inc., with the commitments and undertakings contained in the December 20, 2007 Agreement with the Department of Justice, Department of Homeland Security, and the Department of Defense.
