This is a Notice of Violation (“Notice”) issued pursuant to Section 1.89 of the Commission’s Rules1 to Lorraine Cab Inc.(“Lorraine”), licensee of private land mobile radio station KQB547 in Dearborn, Michigan. 2. On July 14, 2009 and July 17, 2009, agents of the Commission’s Detroit Office monitored and inspected radio station KQB547 located at Dearborn, Michigan, and observed the following violations: a. 47 C.F.R. § 1.903(a): “…General Rule. Stations in the Wireless Radio Services must be used and operated only in accordance with the rules applicable to their particular service as set forth in this title and with a valid authorization granted by the Commission under the provisions of this part..." Lorraine is licensed to operate a base station at a transmitter location identified as 15000 W. Warren, Dearborn, MI, with coordinates 42-20-05.1N, 083-11-46.7W. During the inspection on July 14, 2009, the agents determined that the coordinates for this transmitter location are actually 42-20-40N, 083-11-31W approximately 0.706 miles north of the licensed coordinates. The coordinates must be corrected on the station license. b. 47 C.F.R. § 90.425(a): “Except as provided for in paragraphs (d) and (e) of this section, each station or system shall be identified by the transmission of the assigned call sign during each transmission or exchange of transmissions, or once each 15 minutes (30 minutes in the Public Safety Pool) during periods of continuous operation. The call sign shall be transmitted by voice in the English language or by International Morse Code in accordance with paragraph (b) of this 147 C.F.R. § 1.89. Federal Communications Commission 2 section….” On July 17, 2009, between 8:50 a.m. and 10:00 a.m., Lorraine did not transmit its call sign identification for station KQB547 on the frequency 152.36 MHz. c. 47 C.F.R. § 90.437(b): “Posting station licenses…Entities authorized under this part must make available either a clearly legible photocopy of the authorization for each base or fixed station at a fixed location at every control point of the station or an address or location where the current authorization may be found...” During the inspection on July 14, 2009, no copy of the station authorization was made available to show to the agents. 3. Pursuant to Sections 403 and 308(b) of the Communications Act of 1934, as amended,2 and Section 1.89 of the Commission's Rules, Lorraine Cab Inc., must submit a written statement concerning this matter within twenty (20) days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific action(s) taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action(s). The response must be complete in itself and signed by a principal or officer of the licensee.
