Although the application was submitted last year, the City has yet to receive the status oftheir application. In 2007, the Bayonne Police Department applied for and received a temporary radio license for a 4 watt low power radio channel in order to allow the Police and Fire Departments to communicate outside oftheir radio system, with the intent to keep the low power temporary license until the frequency became available in a higher 40 watt license. When the frequency finally became available in early 2008 the city's radio consultant filed the necessary licensing applications with the FCC in accordance with FCC instructions. Unfortunately, there has been little action by the FCC in processing the license application and now the city's temporary license to transmit has expired. In particular, from my understanding, the application is now stalled in the engineering department ofthe FCC in Gettysburg, Pennsylvania. Having this additional frequency licensed at full power capability would be critical to the Police Department's operations as available frequency is difficult to find in the New York metropolitan area. I ask that you please update me on the status ofBayonne's application and review it in a timely manner. For your convenience the pending application file number is 0003074060, and the frequency number in question is 470/473.1500,12.5 kHz. Should you have any questions regarding this case, please contact Kaylan Koszela in my Washington D.C. Office at (202) 225-7919. Thank you for your time and I appreciate your attention to this matter. ®~11 1278
